If, after the plaintiff has reviewed the sample, the parties remain in dispute, they will so advise me and I will rule on this portion of the plaintiff's motion to compel production. (2) With respect to the plaintiff's request for a copy of the corporate defendant's franchise agreement with a non-party, the request is not reasonably calculated to lead to the discovery of admissible evidence as to any claim against any defendant currently in the case; it is instead designed to discover if there might be the basis for asserting a new claim against a new defendant. Accordingly, I denied that portion of the plaintiff's motion to compel.
