ORDER granting 20 Motion for Extension of Time to Complete Discovery: Defendant's counsel writes, on behalf of the parties, to request a 30-day extension of the February 28, 2018 discovery deadline. ECF No. 20. The parties believe that this case will be settled and have held discovery in abeyance pending settlement negotiations. The parties cannot decide to stay discovery without the Court's approval. The Court held an initial conference on November 9, 2017 and set a discovery schedule. The parties should have requested a stay. Nevertheless, as the parties believe they will reach a settlement, the Court will grant the short extension of time to complete discovery. The parties shall complete all fact discovery by March 30, 2018. Any party wishing to file a dispositive motion shall write to Judge Kuntz to request a pre-motion conference by April 13, 2018, in accordance with his individual rules. No further requests for an extension of time shall be granted unless good cause is shown. ORDER granting 13 Motion to Reopen Case: Plaintiff's motion to reopen this case was referred to me. ECF No. 13. On May 9, 2016, plaintiff filed a stipulation withdrawing his class action allegations without prejudice. The stipulation was so ordered by the Court. ECF No. 12. Based on the stipulation, plaintiff's case was erroneously closed. This was a ministerial error, as the stipulation only withdrew the class action allegations. Plaintiff's Fair Debt Collection Practices Act claim should proceed. Accordingly, plaintiff's motion is granted and the Clerk of Court is directed to reopen plaintiff's case. The Court shall hold a status conference on November 9, 2017 at 2:30 p.m. in Courtroom 11A South of the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The parties shall file a status report by November 6, 2017. The parties are advised that they must contact each other before making any request for an adjournment to the Court.
