ORDER for Supplemental Briefing re 57 75 79 80 108 109 Defendants motions to dismiss: The Court directs the parties to submit supplemental briefing on January 25, 2018 regarding the Attorney Generals statutory and common law standing to bring an action in parens patriae under the N.Y.C. Clinic Access Act, N.Y.C. Admin. Code § 8-803(a). The Attorney General shall file one brief; Defendants shall file one combined brief; and the New York City Council may file one brief, if it so chooses. None of the three allowable briefs shall exceed four pages in length. Supplemental briefing shall address two issues: (1) whether N.Y.C. Clinic Access Act authorizes the Attorney General to enforce the Acts civil provisions in parens patriae, and (2) if not, whether the common law authorizes the Attorney General to do so. The briefs shall address the burden of persuasion on this issue; the Second Circuits opinion in Connecticut v. Physicians Health Servs. of Conn., 287 F.3d 110, 120 (2d Cir. 2002); the N.Y.C. Clinic Access Acts failure to provide a civil right of action for the Attorney General in either § 8-804 or § 8-805; and the N.Y.C. Clinic Access Acts statement that [n]o provision of this chapter shall be construed or interpreted so as to limit the lawful exercise of any authority vested in... a law enforcement officer of New York City, New York State or the United States acting within the scope of his or her official duties, § 8-807(c). The parties shall not incorporate any of their past arguments by reference. So Ordered by Judge Carol Bagley Amon on 1/23/2018. (Angelatos, David)

Minute Entry & Order for Status Conference held before Judge Carol Bagley Amon on January 17, 2018. Appearances: For the New York Attorney General - Sandra Pullman. For Defendant 2A0B5FB - Horatio Mihet and Roger Gannam. For Defendants BE5AB4A and D92887E - Kate Oliveri and B. Tyler Brooks. For the remaining Defendants - Martin Cannon and Steve Crampton. For non-parties Choices Women's Medical Center ("Choices") and 15D429D - Rena Andoh and Danielle Vrabie. As stated on the record, the Court will hold oral argument on Defendants' motions to dismiss on January 29, 2018 at 11:00 AM in Courtroom 10D South before Judge Carol Bagley Amon. The Court denied 157 15D429D motion for a protective order. The Court temporarily granted 150 the Attorney General's motion for a protective order prohibiting his deposition pending resolution of Defendants' motions to dismiss. The Court granted in part and denied in part 138 Choices' motion for a protective order and to quash the non-party subpoena served by Defendant 2A0B5FB. The Court held that, to comply with the non-party subpoena's document requests, Choices may respond to each such request, individually and in writing, stating either that Choices does not have any documents responsive to that request or that Choices has produced some or all responsive documents to the New York Attorney General's Office. Choices need not produce to Defendant 2A0B5FB any responsive documents it has already produced to the Attorney General's Office. Choices must, however, produce to Defendant 2A0B5FB any responsive documents that it did not produce to the Attorney General's Office. The Court held that Choices shall construe the non-party subpoena's Rule 30(b)(6) topics as interrogatories and respond appropriately on or before January 26, 2018. When so responding, Choices may redact patient names pursuant to the protective order in place in this action. With regard to 151 the Attorney General's motion for protective order striking topics in Defendants' Rule 30(b)(6) notice, the Court ruled that, in lieu of producing a witness with knowledge of the challenged Rule 30(b)(6) topics, the Attorney General's Office shall provide Defendants with an official statement withdrawing the disclaimer included in their responses to Defendants' interrogatories on or before January 26, 2018. The Attorney General's Office will also produce a Rule 30(b)(6) witness to testify regarding the Rule 30(b)(6) topics to which the Attorney General's Office did not object. Finally, the Court held, with the consent of all parties, that the preliminary injunction hearing and the trial on the merits shall be de-coupled. The preliminary injunction hearing is scheduled to begin on February 12, 2018 in Courtroom 10D South before Judge Carol Bagley Amon. On the record, the Court stated that the hearing would run from February 12 through February 15, and that it would resume on February 22, 2018. The Court now corrects that statement: The preliminary injunction hearing will resume on February 21, 2018--not February 22. Before that hearing begins, the parties shall abide by the following deadlines: discovery shall close on January 31, 2018; the parties shall exchange exhibit lists and witness lists on February 2, 2018; the Attorney General's Office shall serve on Defendants its pre-trial order on February 2, 2018; Defendants shall serve on the Attorney Generals Office their pre-trial order on February 6, 2018; and the parties shall file their joint pre-trial order with the Court on February 9, 2018. The Court will hear any argument regarding the joint pre-trial order on February 12, 2018 at 10 AM in Courtroom 10D South before Judge Carol Bagley Amon, immediately before the start of the preliminary injunction hearing. Accordingly, the pre-trial conference previously set for February 5, 2018 is adjourned. So Ordered by Judge Carol Bagley Amon on January 17, 2018. (Court Reporter Annette Montalvo.) (Angelatos, David)

ORDER denying as moot 139 Motion to Disqualify Magistrate Judge Orenstein: Pursuant to a standard referral order, discovery matters in this case were referred to a randomly assigned magistrate judge: Magistrate Judge Orenstein. Since then, defendants filed a motion to disqualify Magistrate Judge Orenstein pursuant to 28 U.S.C. §§ 144, 455. As the judge whose disqualification was sought, Magistrate Judge Orenstein denied the § 455 motion by opinion dated January 8, 2018. The § 144 motion remains pending before this Court. In order to have a full understanding of all of the issues to be resolved in the trial scheduled to begin on February 12, 2018 and to expedite the resolution of the case, the Court will directly supervise the discovery in this action. Accordingly, the defendants disqualification motion is denied as moot. So Ordered by Judge Carol Bagley Amon on 1/8/2018. (Angelatos, David)

ORDER denying 63 Motion for Leave to Appear Pro Hac Vice -- An attorney seeking admission pro hac vice must file "a certificate of the court for each of the states in which the applicant is a member of the bar, which has been issued within thirty (30) days of filing and states that the applicant is a member in good standing of the bar of that state court." Loc. Civ. R. 1.3(c) (emphasis added). The record reveals that the movant is not now able to comply with that requirement. See Docket Entry 63-1 para. 6. I therefore deny the motion without prejudice to renewal when the movant is in a position to satisfy the requirements for admission. Ordered by Magistrate Judge James Orenstein on 7/24/2017.
