ORDER: The motion for discovery 29 is denied. Plaintiff's motion for attorney's fees does not require nor necessitate discovery into the attorney's fees of Defendant. The fact that Defendant used counsel from another district is irrelevant to the ordinary rate that would be awarded in this District or that would be awarded in this case. It appears that, rather than provide the fee and costs records from their own files, Plaintiff's counsel are attempting to justify their fees and their facially deficient fees application through the records of Defendant. Discovery in this case has closed. "A request for attorney's fees should not result in a second major litigation." Hensley v. Eckerhart, 461 U.S. 424, 437 (1983). Such insight is irrelevant to Plaintiff's application. "The amount of hours that is needed by one side to prepare adequately may differ substantially from that for opposing counsel, since the nature of the work may vary dramatically. The case may have far greater precedential value to one side than the other." Johnson v. Univ. Coll. of Univ. of Ala. in Birmingham, 706 F.2d 1205, 1208 (11th Cir. 1983); Samuel v. Univ. of Pittsburgh, 80 F.R.D. 293, 294 (W.D. Pa. 1978) ("In the instant case, since defense counsel are not pursuing a claim for counsel fees, it would be highly inappropriate to sanction plaintiffs' request. In our judgment, the number of hours required by opposing counsel to defend a claim has little relevance to the reasonableness of the number of hours which plaintiffs' counsel devoted to pursuing a cause of action on behalf of a plaintiff in a given case."). None of the cases cited by Plaintiff support the discovery sought. That is, none of the cases involve discovery into fees and did not authorize discovery into the opposing counsel's rates or fees. The cases appear to be cited as an attempt to argue that this Court should utilize rates from another district in this case. The Court has already indicated what rates are customary in cases in this District. To the extent Plaintiff wants to argue that a deviation from the practice of using the ordinary fees ranges used in this District is appropriate, she may do so in her briefs. Discovery is unnecessary to such an argument. "By considering reasonable local rates and the nature of the case, the court will be able to decide plaintiff's fee request without the defense information." Canlas v. Eskanos & Adler, P.C., No. C05-375, 2006 WL 3227873, at *1 (N.D. Cal. Nov. 7, 2006). Because the Court finds discovery inappropriate, it enters a protective order and finds that Defendants do not have to answer the discovery already served. In addition, a two month extension of time is unnecessary for a fee application. The deadline to file a renewed fee application is extended by two weeks to April 22, 2019.
