MEMORANDUM AND SCHEDULING ORDER PURSUANT TO FED. R. CIV.P. 16(b): All discovery with respect to the Restatement and Carryback claims is stayed until December 15, 2009, as provided in the July 24, 2009 Order of Severance. Depositions may be conducted freely by both sides until further order. The parties agree that the following documents shall be excluded from discovery: (1) drafts of any testifying expert reports; and (2) written communications between an expert (both testifying experts and consulting experts) and counsel concerning any expert's opinion or consulting work; provided, however, that the documents described in this paragraph shall be discoverable to the extent that the testifying expert has relied upon them in forming his or her expert opinion, or to the extent that such individual lS a relevant fact witness. Trial will be by jury as requested by defendant pursuant to 28 U.S.C. 2402. The parties agreed, and the Court reserved decision on, the proposition that: After a determination as to the validity of the claimed items of income, deductions and credits at issue, the parties shall, within 90 days of the determination, submit to the Court an agreed calculation of the resulting tax, interest and refund, if any. If the parties fail to reach an agreed calculation within that time, the parties shall, on the 90th day, submit to the Court the separate calculation of tax, interest and refund of each party and a description of the reasons for the differences in the calculations. The Court will thereafter enter a final judgment based on the Court's findings and determinations as to the correct calculation of the tax, interest, and refund, if any. After January 15, 2010, plaintiff may serve a Statement of Undisputed Material Facts, as provided in my November 4, 2009 Order. A further conference will be held at counsel's convenience after defendant has responded to any Statement of Undisputed Material Facts served by plaintiff in accordance with my November 4, 2009 Order, or in late February 2010 if no such statement is served.
