REPORT AND RECOMMENDATIONS, I recommend that counsel be awarded fees and costs as follows: The Cohens a total of $78,393.65; Arleo the total of $8,896.65. This would warrant payment by defendant of a total of only $87,290.30 for plaintiffs' attorneys' fees and expenses. Should the Court find, however, that the proposed attorneys' fee award is fair in the context of the overall settlement, then I would recommend, in the alternative, that the fees incurred to date by each counsel be increased pro rata (by a multiplier that calculates to approximately 1.44), as follows: The Cohens a total of $112,185.00 and Arleo a total of $12,815.00.
