ORDER: IT IS HEREBY ORDERED THAT Petitioner's request that the Court supervise Respondent's deposition is GRANTED. The parties shall appear on August 15, 2018 at 9:30 a.m. in Courtroom 905 of the Thurgood Marshall United States Courthouse, 40 Foley Square, New York, New York, for Respondent 98DB895 deposition. IT IS FURTHER ORDERED THAT Petitioner's request that the Court order Respondent to produce all documents concerning the Landmark Trust and find that she waived any privilege that may have attached to those documents is GRANTED in part and DENIED in part. Respondent shall produce all documents in her possession concerned the Landmark Trust. To the extent that Respondent intends to assert privilege over any of those documents, Respondent shall submit a privilege log and a memorandum explaining why each document is privileged and should not be produced. However, Petitioner's request that the Court find that Respondent has waived any claim of privilege is denied. IT IS FURTHER ORDERED THAT Petitioner's motion for attorneys' fees and costs is DENIED without prejudice to renewal. The Court finds that it will be more efficient to have Petitioner submit one comprehensive motion for attorneys' fees and costs after all costs arising out Respondent's misconduct, including the costs of the August 15, 2018 deposition, have been incurred.
