ORDER CONCERNING SETTLEMENT. On May 9,2007, I approved a settlement of this case. Pursuant to agreed and ordered procedure, plaintiff submitted a proposed order for division of the proceeds of settlement. I decline to approve the proposed division. The essential point of disagreement arises from a proposed distribution to plaintiff's attorneys of 25 percent of the net settlement. All settlements thus far have been based on a 15 percent attorney's fee, based on the net settlement proceeds. I have declined to approve settlements that allocated more to attorneys... the Filipov settlement will be approved if attorneys' fees are limited to 15 percent of net proceeds. Plaintiff Filipov and Motley Rice LLC shall resubmit an application for a division of settlement proceeds conforming to this order. (Signed by Judge Alvin K. Hellerstein on 6/28/07) Filed In Associated Cases: 1:21-mc-00097-AKH-THK, 1:03-cv-07076-AKH(rjm)

SUMMARY ORDER. The parties appeared before me on 6/14/07 for an oral argument on four motions: Defts. moved for a determination of applicable law concerning the standard of care against which their conduct is to be measured in these consolidated cases arising under the Air Transportation Safety and System Stabilization Act of 2001. The motion is denied without prejudice... Defts. moved for a determination of the scope of discovery it may obtain from the government, and in particular whether they may discover from the government pre-September 11 intelligence and other threat information known to the government but not conveyed to Defendants. The motion is denied without prejudice... Defendants moved to strike wrongful death plaintiffs' claims for punitive damages... the motion is granted with respect to plaintiffs Teague (03cv6800) and Falkenberg (02cv7145). With respect to the remaining plaintiffs' punitive damages claims, decision is reserved, and an opinion and order will issue. Plaintiffs suing for the wrongful death of eight passengers who perished on board United Airlines Flight 93 moved for a determination that Pennsylvania law governs their claims for compensatory damages. Decision is reserved, and an opinion and order will issue... The exhibit binder proposed to be filed under seal, containing the exhibits identified in WTCP's letter of 5/25/07, shall be filed publicly, unless within 10 days, the Transportation Security Administration identifies matters within those exhibits that should be filed under seal. By email to Chambers, Defts represent, in the context of a motion to declare domicile, that Plaintiff consents to enlarge Defts' time to file reply briefing by 6/29/07. The extension is granted. The parties shall appear for a status conference on 6/25/07, 4:00pm. This Document relates to 21MC97 and 21MC101. (Signed by Judge Alvin K. Hellerstein on 6/22/07) (rjm)
