Mr. Gleason has moved for a protective order over purportedly privileged informationthat Mr. Gleason states he has disclosed to Mr. Cohen "in furtherance of [Mr. Gleason J's role as an attorney investigating a potential claim and or representing clients." (ECF No. 51, at 5-6.) Mr. Gleason appears to be arguing that the "common interest" exception to waiver of the attorney-client privilege should apply to those disclosures. However, Mr. Gleason's submission does not allege facts that meet the test for a finding of "common interest," which requires that the parties and their respective counsel have decided upon and undertaken a "joint defense effort or strategy." I understand that you are handling the case. If I believe that records of other clients, not covered by the search warrant or in any way connected with the investigation covered by the search warrant were improperly seized by the FBI agents, can you issue a bench warrant for the arrest of the FBI agents who conducted the operation and force them to return the documents? It would seem ludicrous to ask the FBI to investigate and arrest their own people for illegal activities. I assume there is no legal prohibition to raise this issue in the press. The agenda will include an update from the Government on its production to Mr. Cohen's counsel of a set of the seized materials. Counsel should be prepared to address the process to be undertaken by a Special Master, should one be appointed, to review claims of privilege. In advance of the conference, the Court seeks a clearer understanding of the resources counsel for Mr. Cohen and the Intervenors have available to review materials for privilege and to produce such materials to a Special Master. Accordingly, by 5:00 p.m. on Wednesday, April 25, 2018, counsel for Mr. Cohen, the President, and the Trump Organization shall each submit a letter describing such resources for the expeditious production of non-privileged materials; the review of potentially privileged materials; the creation of privilege logs (if privilege logs are necessary); and providing a Special Master with any necessary information to make timely and accurate determinations as to privilege.
