SUPPLEMENTAL DISTRIBUTION ORDER APPROVING ADMINISTRATIVE DETERMINATIONS OF CLAIMS ADMINISTRATOR AND AMENDING DISTRIBUTION PLAN. IT IS HEREBY ORDERED THAT: 1. This Order incorporates by reference the definitions in the Stipulation and Agreement of Settlement in this Action (ECF No. 116-2) (the "Stipulation"), the Declaration of Edward J. Sincavage in Support of Motion for Approval of Distribution Plan (ECF No. 132) (the "Distribution Declaration"), and the Sincavage Declaration, and all terms not otherwise defined herein shall have the meanings as set forth in those documents. 2. This Court has jurisdiction over the subject matter of the Action and over all parties to the Action, including all Class Members. 3. The Court approves the administrative determinations of HR&S adjusting the Recognized Loss amounts and distribution amounts of the Affected Claimants as set forth on Exhibit A to the Sincavage Declaration. No further adjustments may be made to any Proofs of Claim for any reason. 4. The Court approves the reissuance of Distribution checks to fourteen (14) Authorized Claimants whose original checks were voided pursuant to the terms of the January 24, 2011 Order Approving Distribution Plan (ECF No. 137) (the "Distribution Order") and from whom HR&S received requests for reissuance of their checks as of September 19, 2012. No further voided checks from the initial Distribution will be eligible for reissuance. 5. Following (a) payment to the Affected Claimants as set forth on Exhibit A to the Sincavage Declaration; (b) the reissuance of checks to as set forth in paragraph 4 above; and (c) payment of the estimated fees and expenses that HR&S will incur in connection with the first redistribution (in the amount of $9,450), as well as any taxes that may be due (including the costs of preparing any tax returns); HR&S is directed, pursuant to paragraph 3(f) of the Distribution Order, to distribute 100% of the remaining balance of the Net Settlement Fund to Authorized Claimants who have cashed their Distribution checks, as well as the Affected Claimants who are receiving their initial distribution pursuant to the terms of this Order, and who would receive at least $10.00 from such redistribution. 6. Paragraph 3(f) of the Distribution Order is modified to provide that if any funds remain in the Net Settlement Fund after the redistribution referred to paragraph 5 above due to uncashed checks or for other reasons, HR&S may conduct additional redistributions to Authorized Claimants who have cashed each of their prior distribution checks and who would receive at least $10 from such redistribution after payment of the costs of the redistribution as well as any taxes that may be due (including the costs of preparing any tax returns), in six-month intervals until there remains less than $10,000 in the Net Settlement Fund. At such time, any remaining balance shall be contributed to non-sectarian, not-for-profit, 501(c)(3) organization(s) designated by Lead Counsel as set forth in paragraph 3(f) of the Distribution Order. In all other respects the Distribution Plan as set forth in paragraph 3 of the Distribution Order shall remain in effect. 7. The Clerk of the Court may close this case.
