STIPULATION OF SETTLEMENT: IT IS HEREBY STIPULATED AND AGREED between the City, the Estate and Radef (the "Parties") as follows: The Estate and Radef agree to pay to the City the amount of $1,000,000, to be paid in four (4) monthly installments ("the Payments") as follows: $250,000 to be paid upon the execution of this Stipulation (the "Execution Date"), a second payment of $250,000 to be paid 30 days after the Execution Date, a third payment of $250,000 to be paid 60 days after the Execution Date and a fourth payment of $250,000 to be paid 90 days after the Execution Date. The Payments will be secured by the Judgment on Consent attached hereto as Exhibit A. The Judgment on Consent shall be held in escrow by the City, to be filed, upon seven (7) days notice, only in the event that a Payment is outstanding for fourteen (14) days or longer. Upon receipt of all four Payments, the City shall sign and file a voluntary dismissal of this action with prejudice and take any additional measures necessary to cause the discontinuance of this action; as further set forth herein.
