MANDATE of USCA (Certified Copy) as to Dwayne Palmer re: 169 Notice of Appeal. Appellant, pro se, moves for a certificate of appealability ("COA") and in forma pauperis ("IFP") status, and an extension of time to file the COA motion. Upon due consideration, it is hereby ORDERED that the motion for an extension of time is GRANTED. ORDER denying MOTION to Vacate under 28 U.S.C. 2255. The Court denies the motion in all respects, with prejudice. In addition, because petitioner has not made a substantial showing of the denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. § 2253. Moreover, the Court certifies that any appeal from this Order would not be taken in good faith, as petitioner's claims lack any arguable basis in law or fact, and therefore permission to proceed in forma pauperis is also denied. See 28 U.S.C. § 1915(a) (3); see also Seimon v. Emigrant Savs. Bank (In re Seimon), 421 F.3d 167, 169 (2d Cir. 2005). Clerk to enter judgment. SO ORDERED. (Signed by Judge Jed S. ORDER as to (05-Cr-538-03) Franz Golding re: 163 REPORT AND RECOMMENDATION TO THE HONORABLE JED S. RAKOFF. On July 2, 2014, the Honorable Frank Maas, United States Magistrate Judge, issued a Report and Recommendation in the above-captioned matter, recommending that the Court deny petitioner Franz Golding's petition filed pursuant to 28 U.S.C. § 2255. Subsequently, on September 11, 2014, petitioner submitted objections to certain portions of the Report and Recommendation. Accordingly, the Court has reviewed the petition and the underlying record de novo. Having done so, the Court finds itself in complete agreement with Magistrate Judge Maas's Report and Recommendation and hereby adopts its reasoning by reference. Accordingly, the Court dismisses the petition in all respects. § 1915(a)(3); see also Seimon v. Emigrant Savs. Bank (In re Seimon), 421 F.3d 167, 169 (2d Cir. 2005). Clerk to enter judgment. SO ORDERED. (Signed by Judge Jed S. REPORT AND RECOMMENDATION TO THE HONORABLE JED S. RAKOFF: as to (05-Cr-538-03) Franz Golding.... Following the denial of his direct appeals, Golding filed a pro se motion seeking to set aside his conviction pursuant to 28 U.S.C. § 2255 ("Section 2255"). In that motion, Golding claims that he was denied the effective assistance of counsel, in violation of the Sixth Amendment, because his trial counsel (a) failed to impeach a Government witness properly at a pretrial suppression hearing; (b) prevented him from testifying on his own behalf during the pretrial suppression hearing and at trial; and (c) failed to advise him adequately concerning his sentencing exposure, thereby causing him to proceed to trial rather than pleading guilty. (Civ. ECF No. 1 ("Petition" or "Pet.") at 6-7; Cr. ECF No. 135 ("Mem.") at 3-12; Golding Aff. 14, 20). Golding further maintains that his appellate counsel was ineffective for failing to raise his trial counsel's inadequacies on appeal. (Mem. at 5-7)....[See this document]... IV. Conclusion: For the foregoing reasons, the Court should deny Golding's Petition. Furthermore, because Golding has not made the substantial showing of the denial of a constitutional right required by 28 U.S.C. § 2253(c), a certificate of appealability should not issue. Objections to R&R due by 7/21/2014. V. Notice of Procedure for Filing of Objections to this Report and Recommendation: The parties are hereby directed that if they have any objections to this Report and Recommendation, they must, within fourteen days from today, make them in writing, file them with the Clerk of the Court, and send copies to the chambers of the Honorable Jed S. Rakoff, United States District Judge, and to the chambers of the undersigned, at the United States Courthouse, 500 Pearl Street, New York, NY 10007, and to any opposing parties. See 28 U.S.C. § 636(b)(1); Fed. R. Civ. P. 6(a), 6(d), 72(b). Any requests for an extension of time for filing objections must be directed to Judge Rakoff. Any failure to file timely objections will result in a waiver of those objections for purposes of appeal. See Thomas v. Am, 474 U.S. 140 (1985); 28 U.S.c. § 636(b)(1); Fed. R. Civ. P. 6(a), 6(d), 72(b). (Signed by Magistrate Judge Frank Maas on 7/2/2014); Copies By Chambers To: Honorable Jed S. Rakoff, Franz Golding, AUSA Jessica A. Masella (via ECF). REPORT AND RECOMMENDATION as to (05-Cr-538-04) Dwayne Palmer. After standing trial with three co-defendants, Dwayne Palmer was convicted of conspiracy to distribute and possess with intent to distribute marijuana; using a firearm to commit murder in furtherance of the conspiracy; using and carrying a firearm during and in furtherance of the conspiracy; and being an alien in possession of a firearm. United States v. Brown, 374 F. App'x 208, 209 (2d Cir. 2010). The conviction was affirmed on appeal, id.; see Palmer v. United States, 131 S. Ct. 313 (2010) (denying petition for writ of certiorari), and Mr. Palmer now moves pursuant to 28 U.S.C. § 2255 to vacate, set aside, or correct his sentence. In his amended motion, Mr. Palmer asserts five grounds for relief: (1) trial counsel provided ineffective assistance by failing to argue certain possible defenses during summation; (2) trial counsel provided ineffective assistance by stipulating to the admissibility of tapes of certain 911 emergency calls without prior investigation into the callers and the veracity of their claims; (3) the prosecution knowingly elicited perjured testimony from its witness, Omar Ken, and (4) the petitioner is actually innocent of the conspiracy and the murder counts. For the reasons that follow, I recommend denying the motion....[See this Report and Recommendation]... Conclusion: For these reasons, I recommend denying Mr. Palmer's motion. Pursuant to 28 U.S.C. § 636(b)(1) and Rules 72, 6(a), and 6(d) of the Federal Rules of Civil Procedure, the parties shall have fourteen (14) days from this date to file written objections to this Report and Recommendation. Such objections shall be filed with the Clerk of the Court, with extra copies delivered to the chambers of the Honorable Jed S. Rakoff, Room 1340, and to the chambers of the undersigned, Room 1960, 500 Pearl Street, New York, New York 10007. Failure to file timely objections will preclude appellate review. (Signed by Magistrate Judge James C. Francis on 3/28/2014); Copies mailed this date by Chambers to: Bruce K. Kaye, Esq., Dwayne Palmer, Jessica A. Masella, Esq. ORDER DIRECTING AFFIRMATION (as to Dwayne Palmer) 28 U.S.C. section 2255: Movant is directed to file an Affirmation showing cause why his Motion should not be dismissed as time-barred within sixty (60) days of the date of this Order. An Affirmation for Timeliness form is attached to this Order, which Movant should complete as specified above. If Movant timely files his Affirmation, the Court shall review it, and if proper, shall order that the Motion be served on Respondent. If Movant fails to comply with this Order within the time allowed, the Motion will be dismissed as time-barred. No answer shall be required at this time. As Movant has not at this time made a substantial showing of the denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. § 2253. The Court certifies pursuant to 28 U.S.C. section 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Jed S. Rakoff on 11/19/2011) (djc) (Entered: 11/22/2011)

ORDER as to (05-Cr-538-03) Franz Golding. On April 19, 2011, the defendant filed a motion for the return of property pursuant to Fed. R. Crim. P. 41. Because the Government has indicated that none of Golding's property is currently in the possession of the United States Attorney's Office or the federal law enforcement agencies which were involved with the investigation of this case, the Court hereby denies Golding's request. However, the Government suggests that some of Golding's property may be in the possession of the New York City Police Department ("NYPD"), the law enforcement agency that initially arrested Golding. Thus, Mr. Golding and/or his family members are free to apply to the NYPD Property Clerk for the return of any property. SO ORDERED. (Signed by Judge Jed S. ORDER as to (05-Cr-538-04) Dwayne Palmer. On April 14, 2011, defendant Dwayne Palmer filed a motion for the disclosure of material that was previously provided to defense counsel prior to Mr. Palmer's trial pursuant to 18 U.S.C. Section 3500 (the "3500 Material"). In his motion, the defendant asserts that the only reason he needs this material is in order to properly prepare a motion to vacate his sentence pursuant to 28 U.S.C. Section 2255. The Government has indicated that it does not object to the defendant's request provided that the Court order certain limitations. Accordingly, the Court grants the defendant's motion subject to the following limitations: (1) Palmer is to use the 3500 Material solely for the purpose of preparing any post-conviction motion or appeal in this case, (2) Palmer may not make additional copies of the 3500 Material, (3) Palmer cannot distribute or disseminate the 3500 Material to any one other than a lawyer who represents him in connection with any post-conviction motion or appeal in this case, and (4) Palmer must return the 3500 Material to the Government at the conclusion of any post-conviction litigation. The Government is hereby directed to furnish a copy of the 3500 Material to Mr. Palmer. SO ORDERED. (Signed by Judge Jed S. Rakoff on 7/15/2011)(bw) (Entered: 07/18/2011)
