Reason for Amendment: Correction of Sentence for Clerical Mistake. Defendant Peter S. Grimm (3) was found guilty on Count(s) 1s-2s, and 4s, after a plea of not guilty. Count(s) underlying Indictment/open counts are dismissed on the motion of the United States. IMPRISONMENT: 36 MONTHS ON EACH COUNTS 1s, 2s, AND 4s TO RUN CONCURRENTLY. The court makes the following recommendations to the Bureau of Prisons: That the Defendant be incarcerated at the Satellite Camp at FCI FT. On October 11, 2011, the Government submitted to Judge Marrero an application for an order to disclose portions of eight consensual recordings that contain potentially privileged material, as well as Brady material, to Defendants in each of the above-listed cases. Concurrently, third parties Investment Management Advisory Group, Inc., David Eckhart, and Martin Stallone moved for a protective order and evidentiary hearing to prevent disclosure of certain recordings. It is hereby ORDERED as follows: The Government shall file its initial application to disclose Brady material in United States v. Carollo, et al., 10 Cr. 654 (HB) and United States v. Ghavami, et al., 10 Cr. 1217 (JFK) and ensure that each judge receives copies of the consensual tape recordings that are the subject of the application, as well as transcripts of those recordings; 2. The Government shall file a response to the motion for a protective order in each of the three cases no later than November 14, 2011; 3. OPINION AND ORDER:#100933 as to Dominick P. Carollo, Steven E. Goldberg, Peter S. Grimm. Before the Court is the Government's "Motion to Clarify or Reconsider the Applicability of Section 3293's Ten-Year Statute of Limitations to Counts Four and Five." On August 25, 2011, I dismissed Count Seven of the Superseding Indictment filed on May 31, 2011 (the "Indictment") holding that the ten-year statute of limitations provided by 18 U.S.C. Section 3293(2) for offenses that affect financial institutions was inapplicable in the absence of any actual loss or a non-de minimis risk of loss by a financial institution. On September 1, 2011 the Government filed the present motion asking the Court to clarify that its Order does not preclude the Government from (i) offering evidence at trial that Financial Institution A suffered an actual loss of $160 million that it paid in penalties, disgorgement, and restitution for its knowing participation in the conspiracies alleged in Counts Four and Five, and (ii) obtaining a jury instruction on Section 3293 with respect to Counts Four and Five if the evidence establishes a factual basis for the requisite effect on a financial institution. Alternatively, the Government asks this Court to reconsider its decision in light of the actual loss incurred by Financial Institution A in this case and allow the Government to show the actual effect at trial....[See Opinion And Order]... ORDER as to Dominick P Carollo, Steven E Goldberg, Peter S Grimm. WHEREAS on April 7, 2011 a Pre-Trial Conference took place, and the following was agreed to, it is hereby ORDERED that by April 13, 2011 the government will submit a letter that provides a timetable describing when it will complete production of the five requests previously made by defendants, or their reason not to respond to any individual request; and it is further ORDERED that the government will complete production with respect to said five requests as expeditiously as reasonably possible, and in no event more than 6 weeks from the date hereof; and it is further ORDERED that by April 13, 2011 in a letter of no more than 5 pages the government will identify the counts that it continues to believe it will pursue at trial and an explanation of how they are in fact representative of distinct conspiracies. I understand the defendants' position as articulated in their recent letter, with color charts included. If after reading the government's submission the defendants have anything new to add, defendants may jointly submit a response of no more than 5 pages by April 18, 2011; and it is further ORDERED, that we, at least for the foreseeable future, have regular status conferences on this matter at approximately thirty (30) day intervals, and you are to plan accordingly. Our next status conference will be on May 19, 2011 at 11:00 A.M. to discuss your submission and any open discovery concerns and a new trial date. BE PREPARED.
