MEMORANDUM OPINION AND ORDER #97204: As to Raffaello Follieri. Mr. Cardillo, an attorney for one of the victims in this case, has filed an application requesting that the Court (1) order the Government to turn over the names of any unindicted co-conspirators, (2) order the Government to release its investigative files in the case, (3) order Yucaipa Corporate Initiatives Fund I, LP ("Yucaipa") and Plainfield Asset Management, LLC ("Plainfield") to produce documents relating to the defendant's investments, and (4) seal "any documents in relation to the restitution." The application to compel the Government to disclose the identities of unindicted co-conspirators is denied.Mr. Cardillo is free to conduct his own investigation, bring any appropriate civil actions, and request information through the Freedom of Information Act ("FOIA"). Mr. Cardillo's request for the Government to release its investigative files in this case is denied. With respect to Mr. Cardillo's third request for an order compelling Yucaipa and Plainfield to turn over various documents relating to the defendant's investments, he cites no legal basis upon which such an order could be granted. Because Mr. Cardillo's client has not cited any authority upon which his request for an order compelling Yucaipa and Plainfield to produce documents and records may be granted, that request is denied. With respect to the sealing request, a blanket order sealing all files pertaining to restitution is overly broad and unnecessary to protect the privacy and reputation of the victim. The Court has carefully protected the privacy of victims and ordered that the identity of victims and any identifying information should be sealed. Finally, Mr. Cardillo states that the amount of restitutionlisted by the Department of Justice as due to Mr. Cardillo's client is $20,000 less than that listed on Schedule A of the Order of Restitution to be paid by the defendant to Mr. Cardillo's client, and to which the defendant and Mr. Cardillo's client stipulated. MEMORANDUM OPINION AND ORDER #96991: As to Raffaello Follieri.The parties have resolved all issues with respect to the victims who should be included in the restitution order, with the exception of six former employees of the Follieri Group (the former employees). Counsel for the former employees arguesthat they are victims within the meaning of the Mandatory Victim Restitution Act (MVRA). The defendant, the Government, and the representative of another victim assert that the former employees are not victims within the meaning of the MVRA.... The parties are directed to submit a proposed judgment of restitution with respect to the agreed upon victims, including a proposed payment schedule. The parties should also provide the Court with the original stipulations with the other victims so that the Court can enter them. ORDER OF FORFEITURE FOR SPECIFIC PROPERTY as to Raffaello Follieri. NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED THAT: 1. As a result of the offenses charged in the Information, to which Raffaello Follieri pled guilty, a money judgment in the amount of $2,440,000.00 shall be entered against Raffaello Follieri. 2. All of Raffaello Follieri's right, title and interest in the Specific Property is forfeited to the United States for disposition in accordance with the law, subject to the provisions of Title 21, United States Code, Section 853(n). 3. The aforementioned Specific Property is to be seized pursuant to this Order of Forfeiture and is to be held thereafter by the United States Marshals Service (or its designee) In its secure custody and control. 4.
