Minute Entry for proceedings held before Judge Nelson Stephen Roman: Sentencing held via teleconference. Defendant 286CCA3 (08) present with counsel Winston Lee, Esq. and Dorea Silverman, Esq. as well as seven family members. AUSA Maurene Comey also present with U.S. Probation Deputy Chief Ed Johnson. Court reporter is Sue Ghorayeb. The Court finds Defendant knowingly, intentionally and voluntarily waives his physical appearance and consents to this proceeding to be conducted telephonically. The Court also found sufficient reasoning pursuant to the CARES Act as to why this Sentencing cant be further delayed without serious harm to the interests of justice. Presentence Report approved with changes to paragraphs 85, 87, 88, 90 and page 25 as stated on the record. The Court sentenced defendant to a term of Ninety-Eight (98) Months with credit for Sixty (60) Months (pursuant to U.S.S.G.ยง 5K2.23) while in state custody, on one count of conviction in the Superseding Indictment (S1). Upon release from imprisonment, the defendant shall be on supervised release for a term of Three (3) Years, subject to the standard conditions 1-12 as well as mandatory and special conditions. Restitution not applicable. Forfeiture not sought. No fine levied. Defendant shall pay the United States $100 Special Assessment due immediately. The Government's oral motion to dismiss the open and underlying counts of conviction in S1 is GRANTED. Although Defendant waived his right to appeal under the plea agreement, the Court directed Defendant's attorney to thoroughly discuss the ramifications of the waiver with Defendant. ORDER as to (17-Cr-506-10) Rayshawn Casanova. By order dated July 31, 2020, the Court directed, inter alia, that the United States Penitentiary Big Sandy, 1197 Airport Road, Inez, Kentucky, make arrangements for Defendant Rayshawn Casanova, an inmate, (1) to undergo medical testing sufficient to determine the extent and severity of his asthma, and (2) to be examined by a licensed pulmonologist. According to medical documents submitted to the Court, an examination of Defendant by Dr. Ayesha Sikder took place on August 28, 2020. Dr. Sikder recommended, among other things, that Defendant receive the medications Symbicort and Singulair. At a telephonic hearing held on September 9, 2020, the Defendant stated that he had not yet received those medications. While the Government states that a medical officer at the United States Penitentiary Big Sandy submitted a request for the medications to the Chief Pharmacist for the Mid-Atlantic Region of the Bureau of Prisons on September 3, 2020, no assurance or estimate could be provided to the Court as to when Defendant may actually receive the medications. Accordingly, the Court directs the Bureau of Prisons to provide forthwith to Defendant Rayshawn Casanova all medications necessary and recommended by Dr. Sikder and any other medical experts following Defendant's Court-ordered medical examinations. The Court directs the Government to serve a copy of this order on United States Penitentiary Big Sandy and the Bureau of Prisons. The Court further directs the Government to provide the Court an update regarding the Bureau of Prison's compliance with this Order by September 23, 2020, at 12:00 P.M. ORDER as to Rayshawn Casanova: On July 21, 2020, Defendant Rayshawn Casanova ("Defendant"), who is currently housed at United States Penitentiary Big Sandy, 1197 Airport Road, Inez, Kentucky, filed a motion to modify his sentence pursuant to 18 U.S.C. ยง 3582(c)(l)(A). On July 31, 2020, the Court conducted a telephonic hearing, during which the extent of the spread of the Coronavirus Disease of 2019 ("COVID-19") at United States Penitentiary Big Sandy and Defendant's medical condition were called into question. The Government represents that United States Penitentiary Big Sandy is well-equipped to administer COVID-19 tests to its inmates. However, Defendant to date has not been tested. Accordingly, it is ORDERED that United States Penitentiary Big Sandy immediately administer a COVID-19 test to Defendant Rayshawn Casanova and produce the results of such test to the Court on or before August 14, 2020, or as soon as practically possible.To aid in further developing the medical record for Defendant, who represents that he suffers from asthma and is at heightened risk of complications due to COVID-19, it is further ORDERED that United States Penitentiary Big Sandy make arrangements for Defendant Rayshawn Casanova (1) to undergo medical testing sufficient to determine the extent and severity of his asthma, and (2) to be examined by a licensed pulmonologist. The examining pulmonologist is directed to render a written determination as to (1) the extent and severity of Defendant Rayshawn Casanova's asthma and (2) whether Defendant Rayshawn Casanova would benefit from additional treatment for his asthma, including but not limited to his being prescribed an Albuterol nebulizer or any other medication such as Singulair or Loratadine. The results of all such tests and examinations, and the written opinion of the examining pulmonologist, shall be produced to the Court on or before September 4, 2020. JUDGMENT IN A CRIMINAL CASE as to 50B66E4 (1). The Defendant pleaded guilty to count One. Open and underlying counts are dismissed on the motion of the United States. IMPRISONMENT: Ninety (90) Months with credit for Thirty-Three and one-half (33) Months (pursuant to U.S.S.G. ยง 5G1.3(b)) while in state custody for an adjusted term to be served of Fifty-Six and one-half (56) Months beginning January 24, 2020, to be served concurrent to New York State case 00208S-2017. Although Defendant waived his right to appeal under the plea agreement, the Court directed Defendant's attorney to thoroughly discuss the ramifications of the waiver with Defendant. The Court makes the following recommendations to the Bureau of Prisons: The Court recommends incarceration at Otisville Correctional Facility or Danbury Correctional Facility or another facility nearest to Westchester County, New York.
