After discussions, it was determined that there may be a method of resolving this dispute that the parties had not previously considered. In order to determine the possibility of negotiating a resolution on that basis, counsel for the defendants requested additional time to gather and develop new information that could provide a basis for further discussions. The court agreed with that proposal and hereby directs counsel for defendants to proceed as discussed. To prepare for mediation, the court conducted 22 ex-parte conferences with most counsel and pro-se parties beginning on 10/31/2017 and continuing to 11/1/2017. During the ex-parte conferences, the court, counsel and pro-se parties discussed background information relating to each landowner and associated legal issues. On 11/2/2017 mediation began, after extensive negotiations, multiple parties reached resolutions of the matters in dispute. Certain parties did not resolve their disputes. The court continued the mediation to the following day. On 11/3/2017 certain parties resolved the matters in dispute and others were unable to do so. Stipulations for dismissal with respect to the resolved claims shall be filed not later than thirty days following the execution of the required settlement documents.
