New counsel for defendant Hills requested a continuance of the trial, due to her recently being retained as new counsel, and due to the volume of discovery involved. Counsel for defendants Alqsous, Al-Madani, and Sayegh do not oppose the request for a continuance and join in the request for a continuance of the trial. Counsel for the government does not oppose the request for continuance. The Court finds that the ends of justice served by the motion for continuance outweigh the best interest of the public and defendants in a speedy trial, because failure to grant such a continuance would deny counsel for each defendant, especially new counsel for defendant Hills, the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. Additionally, the Court finds that this case is unusual and complex due to the number of defendants, the volume and complexities of the discovery, the nature of the prosecution, and the legal issues involved, and that it is unreasonable to expect adequate preparation for pretrial proceedings and trial within the time limits established in Title 18, United States Code, Section 3161, again, taking into account the exercise of due diligence. Waiver of speedy trial forms signed by defendants. The Court sets the following dates in this case: Final pretrial 5/25/2018 at 10:00 AM; Jury selection 6/21/2018 at 8:00 AM; Opening statements and jury trial 6/25/2018 at 8:00 AM. The Court will issue a trial order with all of the dates and deadlines that will govern this case. Counsel for defendants Hills, Al-Madani, and Sayegh requested that the Court revisit the bond conditions that are currently set. The Court will refer the matter to Magistrate Judge Baughman for his review of the conditions of bond that were set at the arraignment. No. [56].) Attorney Nathan Ray informed the Court, after having discussions with defendant Hills, that defendant Hills does not wish to waive any conflict and will seek new counsel. Defendant Hills advised the Court that he will retain new counsel. Attorney Zukerman, on behalf of Zukerman, Daiker & Lear, orally moved to withdraw as counsel for defendant Hills, and the Court granted the unopposed motion. Recognizing that new counsel for defendant Hills will require additional time in which to prepare for trial, the court finds that the ends of justice served by a continuance of all dates and deadlines in this case outweigh the best interest of the public and the defendants in a speedy trial and that the failure to grant an ends of justice continuance will deny new counsel for defendant Hills the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. See 18 U.S.C. Sec. 3161(h). Therefore, all current dates and deadlines as to all defendants are continued. No. [98]) and finds that it does not comply with Rule 17(c), in particular the requirement that the subpoenaed material be sought in connection with a scheduled hearing or trial. While the subpoena satisfies Rule 17(c)'s requirement that the requested materials be produced at the courthouse, the date is not tied to any scheduled court hearing. Accordingly, the government's objection is sustained (Doc. No. [106]), the Court hereby quashes the subpoena, and MetroHealth need not comply with the improperly issued subpoena. Attorneys Richard Perez and Richard Drucker present on behalf of defendant Yazan B. Al-Madani (3). Attorney Jennifer Armstrong present on behalf of defendant Tariq Sayegh (4). Defendants Edward R. Hills (1), Sari Alqsous (2), Yazan B. Al-Madani (3), and Tariq Sayegh (4) present. The Court discussed with counsel and the parties the pending motion to continue and declare the case complex filed by defendants (Doc. No. [54]). No objection by counsel for the government. The Court grants the motion to continue, and finds that the ends of justice served by the motion for continuance outweigh the best interest of the public and defendants in a speedy trial, because failure to grant such a continuance would deny counsel for defendants the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. Additionally, the Court finds that this case is unusual and complex due to the number of defendants, the nature of the prosecution, and the volume of discovery anticipated, and that it is unreasonable to expect adequate preparation for pretrial proceedings and trial within the time limits established in Title 18, United States Code, Section 3161, again, taking into account the exercise of due diligence. Waiver of speedy trial forms signed by defendants. By agreement of all parties, the Court sets the following dates in this case: Final pretrial 5/10/2017 at 1:30 PM; Jury selection 6/2/2017 at 8:00 AM; Jury trial 6/5/2017 at 8:00 AM to begin with opening statements. The Court will issue a Trial Order with all of the dates and deadlines that will govern this case. The Court also discussed the government's motion for a conflicts inquiry regarding defendant Hills' counsel. (Doc. No. [56].) Defendant Hills stated that he intends to retain independent counsel to advise him on the potential conflict raised in the government's motion. With counsel present, the Court contacted the two individuals identified in the government's motion. Following the hearing, the Court contacted Attorney Thomas E. Conway, who has agreed to serve as conflicts counsel for the individual identified in the indictment as "Designee 1." The individual identified as "Attorney 1" will advise the Court if he wishes to retain counsel or have counsel appointed by the Court. A conflict of interest hearing will be held on 1/3/2017 at 10:00 AM. Additionally, the Court addressed the government's motion for a protective order to stay certain discovery in a related state civil action. (Doc. No. [46].) Defendant Hills advised that he does not oppose the motion. For good cause shown, the Court shall grant the government's motion, and will be filing a memorandum opinion explaining its ruling directly. In the interim, defendant Hills shall not depose any MetroHealth employees. Finally, the parties shall file by November 30, 2016 a proposed protective order that will govern discovery in this case.
