The Sixth Circuit Court of Appeals remanded this matter to the District Court to make factual findings relating to the undue-influence enhancement and resentence Defendant Aundre Davis (4). See the Sixth Circuit Opinion 206 . This Court adopts the conclusion in Defendant's Sentencing Memorandum 208 and sustains the objection for the application of the 2-level enhancement for undue-influence, finding the enhancement does not apply. Defendant is committed to the custody of the Bureau of Prisons for a term of 360 months as to Count 1 and 360 months each as to Counts 4, 5, 6, 7, and 8 of the Superseding Indictment, all to run concurrent to one another, for a total of 360 months in prison. This Court adopts all other aspects of the sentencing imposed during the December 28, 2017 Sentencing Hearing: 10 years each of supervised release as to Counts 1, 4, 5, 6, 7, and 8 of the Superseding Indictment, to run concurrent to one another, for a total of 10 years.
