Order [non-document] as to 2123618: Defendant's motion, as supplemented, to reduce sentence (Doc. No. 128 ; and see also Doc. No. 123 ) is DENIED for reasons highlighted herein. The Court finds that 2123618 has now exhausted his administrative remedies, and it, therefore, turns to the inquiry set forth in 18 U.S.C. § 3582 and discussed in United States v. 2123618, 980 F.3d 198, 1101 (6th Cir. 2020) and United States v. Elias, No. 20-3654 (6th Cir. Jan. 6, 2021) (recommended for publication). The Court finds that defendant has not established the existence of extraordinary and compelling reasons. He offers no documentation that he suffers from any medical condition that has been identified as increasing his risk of suffering serious complications from COVID-19, and the existence of the pandemic or the restrictions imposed as a result of the pandemic are not sufficient to establish extraordinary and compelling circumstances. But even if the Court found the requisite extraordinary and compelling reasons, a reduction of the prison term would not be appropriate in light of the sentencing factors in 18 U.S.C. § 3553(a). See United States v. Sherwood, No. 20-4085 (6th Cir. Feb. 1, 2021) (citing 18 U.S.C. § 3553(a) and directing district courts to consider all relevant statutory sentencing factors) (recommended for publication). The underlying offenses for which defendant was convicted were serious and inherently dangerous. Defendant participated in the armed robbery of a convenience store and brandished a weapon to further the crime. Additionally, at the time he committed the underlying offenses, he was on post release control for aggravated robbery that involved violence toward several victims. The Court is concerned that prior terms of imprisonment have failed to deter his violent and illegal behavior. The Court has considered the programming defendant has completed in prison, his childhood history of physical and psychological abuse, his problems with drug abuse, and the fact that he came from a broken home. But after considering all of the factors, the Court finds that a reduction in 2123618 sentence would undermine the need for the sentence imposed to reflect the seriousness of the offense, protect the public, promote respect for the law and specific deterrence, and ensure just punishment. Based upon these same facts, the Court also finds that defendant poses a danger to the community and to other persons. Further, to the extent that defendant requests to be released and to serve a period of supervised release on home confinement, for the reasons already stated, 2123618 is not an appropriate candidate for release under § 3582, even with conditions. Defendants CEE7DD7, CFF86F1. and 2123618 present. The Court addressed the unopposed motion to continue and to declare case complex filed by defendant 2123618 (Doc. No. 22 ), which indicates that all parties concur in the motion. All counsel and defendants reaffirmed their concurrence in the motion. Counsel for all defendants orally moved the Court to order that a pre-plea PSR, as to criminal history, be prepared by the probation office. Counsel for the government does not oppose the motion to continue and to declare case complex, and does not oppose oral motions for pre-plea PSR. The Court grants the motion to continue and finding case complex, and also grants the oral motions for pre-plea PSR, but requested that each counsel follow up with the filing of a motion for pre-plea PSR. The Court finds that the ends of justice served by the motion for continuance outweigh the best interest of the public and defendant in a speedy trial, because failure to grant such a continuance would deny counsel for defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. Additionally, the Court finds that this case is unusual and complex due to the volume and nature of discovery, and the nature of the prosecution, and that it is unreasonable to expect adequate preparation for pretrial proceedings and trial within the time limits established in Title 18, United States Code, Section 3161, again, taking into account the exercise of due diligence. The trial set for 3/14/16 is continued. The Court sets a status hearing for 4/19/2016 at 10:00 AM, at which time the Court will set trial dates and deadlines.
