The Panel's Order in this case (Doc. 128) remains in full force at this juncture. Mr. Kincaid is ORDERED to attend his deposition on 1/17/19. The Court notified Mr. Kincaid's attorney (Mr. Sheehy) that Mr. Kincaid's failure to appear for his deposition may result in contempt; Mr. Sheehy represented to the Court that Mr. Kincaid planned to not attend his deposition--in violation of this Court's direct Order--and would appeal any contempt order (though Mr. Kincaid expressly waives any argument that his failure to appear at his deposition should be excused on account of an "illness/injury" that an unsigned doctor's note states should keep him out of work through 1/17/19, the date of his deposition). The Court ORDERS that Plaintiffs be permitted to depose Mr. Kincaid for up to seven hours on the grounds that Mr. Kincaid previously withheld voluminous documents and extensive testimony pursuant to a First Amendment Privilege objection that this Court has since found to be insufficient to justify non-disclosure. PRETRIAL PROCEDURAL ISSUES: The Court ORDERS that deposition designations be filed by 2/4/19, counter designations and objections be filed by 2/11/19, and objections to the designation objections be filed by 2/18/19. The Court ORDERS that any forthcoming Daubert motions be filed separately from any forthcoming motions in limine (which are required to be filed as omnibus motions pursuant to this Court's 1/11/19 Notation Order). Minute Entry and Notation Order: This case came on for a status conference by telephone on December 28, 2018 at 4:00 p.m. The Court, with the concurrence of the three Judges, DENIES the emergency motion (Doc. 129), of the Republican National Committee, the National Republican Congressional Committee and Adam Kincaid, to stay this Court's Order of December 21, 2018 (Doc. 128) granting the motion to compel compliance with subpoenas (Doc. 11 in case no. 1:18mc31). In evaluating whether a stay is appropriate, courts consider the traditional injunction factors, i.e., (1) whether the [respondent] has a strong or substantial likelihood of success on the merits; (2) whether the [respondent] will suffer irreparable harm if the district court proceedings are not stayed; (3) whether staying the district court proceedings will substantially injure other parties, and (4) where the public interest lies. Here: (1) Respondents have not shown a "strong or substantial likelihood of success on the merits" for the reasons stated in the Court's prior Order. The documents sought are highly relevant, and the breadth of Respondents' conclusory assertions of privileges are not well-taken. (2) Respondents will not be "irreparably harmed" by attorneys-eyes-only disclosure to Plaintiffs' attorneys, during the pendency of the appeal, which attorneys are bound to use these documents only for the purpose of this lawsuit. A limited production, to Plaintiffs' attorneys, for a short period of time until the Sixth Circuit issues a decision, does not constitute "irreparable harm;" (3) staying disclosure of these documents will prejudice Plaintiffs in preparing for trial, as delay will interfere with dispositive motions which are due on 1/8/19, the anticipated re-opening of Respondents' deposition by 1/15/19, exhibit/witness lists which are due on 1/18/19, and the Final Pretrial Conference which is on 2/11/19; and (4) the public interest is served by resolving this constitutional challenge to Ohio's congressional map quickly and upon consideration of all available information. Accordingly, Respondents' emergency motion to stay is DENIED. The Court intends to order the responsive documents to be produced by January 4, 2019 at noon, unless such production is stayed by the Court of Appeals, or unless this Court otherwise orders. Defendants shall use their best-faith efforts to supplement their answers to Plaintiffs' interrogatory no. 1 by 8/8/18, including determining whether Heather Blessing (Mann) or Ray DiRossi provided non-secretarial assistance in the redistricting of the Ohio congressional maps in 2011. Defendants shall supplement this answer again, if applicable, after completing document production. Legislative Privilege. This case is set for another status conference by telephone on 8/31/18 at 2:00 p.m. to discuss the issue of legislative privilege. By 8/28/18, Defendants shall inform Plaintiffs whether they are withholding documents on the grounds of legislative privilege. By 8/30/18, the parties shall file statements of not more than three pages setting forth their position in regards to the issue of legislative privilege (or, alternatively, informing the Court that no such issues exist). If the issue of legislative privilege does require briefing, the following briefing schedule applies: Plaintiffs' motion to compel (9/7/18), Defendants' memorandum in opposition (9/14/18), Plaintiffs' reply (9/18/18). Alternative Service of Subpoena. Plaintiffs are authorized to serve a second subpoena on Tom Whatman by serving the subpoena, via certified mail, at the following locations: (1) the residence of Mr. Whatman's parents; (2) the other addresses believed to be Mr. Whatman's residence; and (3) Mr. Whatman's place of employment. The Court finds that service via certified mail at all of these locations reasonably insures Mr. Whatmans' actual receipt of the subpoena. ESI Protocol. The parties have jointly filed an agreed ESI Protocol Order. The Court will review the proposed order and act accordingly. Protective Order. The parties submitted a proposed stipulated protective order. (Doc. [47]-1). Paragraphs 2(h) and 6 allow certain filings to be made under seal. The parties shall forthwith amend these paragraphs to comply with binding Sixth Circuit precedent holding that parties cannot agree to file documents under seal, and requiring a party seeking to file under seal to establish compelling reasons for the seal that outweigh the public's interest in access to court records, and further establish that the seal is narrowly tailored to those compelling reasons.
