ORDER: Plaintiff has filed a Motion for Appointment of Counsel 109 . Generally, there is no constitutional right to counsel in a civil case. United States v. 30.64 Acres of Land, 795 F.2d 796, 801 (9th Cir. 1986). However, pursuant to 28 U.S.C. § 1915(e), this Court has discretion to request volunteer counsel for indigent parties in exceptional circumstances. Wood v. Housewright 900 F.2d 1332, 1335 (9th Cir. 1990); Wilborn v. Escalderon, 789 F.2d 1328, 1331 (9th Cir. 1986). To determine whether exceptional circumstances exist, this Court evaluates the party's likelihood of success on the merits and her ability to articulate her claims pro se in light of the complexity of the legal issues involved. Wood, 900 F.3d at 1335-36; Wilborn, 789 F.2d at 1331. At this stage, the Court does not find that exceptional circumstances exist to warrant appointment of counsel. The remaining facts and legal issues involved in this case are not of substantial complexity to necessitate appointment of counsel, and plaintiff has demonstrated an ability to articulate her claims. OPINION AND ORDER: Several of plaintiff's causes of action fail to state a claim. Plaintiff has already amended her complaint once as to each of those claims, but those amendments did not cure the deficiencies. At this point, I conclude that further amendment would be futile. Plaintiff's equal protection, fraud, and conspiracy claims are therefore dismissed with prejudice. All claims against the EPA are also dismissed with prejudice. See Kendall v. Visa U.S.A., Inc., 518 F.3d 1042, 1051 (9th Cir. 2008) ("Dismissal without leave to amend is proper if it is clear that the [claim] could not be saved by amendment.").
