ORDER: This matter is before the court on cross motions for summary judgment on the claims brought by eight individual class members against Caterpillar, Inc. Docket Nos. 385 (Caterpillar's motion), 409 (Plaintiffs' motion). For the reasons stated in the accompanying Memorandum, judgment is entered for the following plaintiffs: Beverly Carson, Wilma Farrenholz, Hattie Grace, Sharon Houser, Laura Mansfield, Florence Miller, Charlotte Seibert, and Nancy Virden. McClow, or in the Alternative, to Strike the Declaration of Roger J. McClow 259 is DENIED. Caterpillars Third-Party Complaint against the UAW is DISMISSED. The Motions for Summary Judgment filed by Kerns plaintiffs 213 and by Caterpillar 214 are GRANTED IN PART AND DENIED IN PART as described in the attached Memorandum. As the liability issues that would have been the subject of the June 2010 and August 2010 trials set in these cases have been resolved, those trial settings will be removed from the calendar.
