Minute Entry for proceedings held before Magistrate Judge Tu M. Pham: Telephonic Hearing held with Magistrate Judge Pham, present on the phone were James R. Mulory, II, for Select Family and Joseph M. Crout for EEOC. The Magistrate Judge had received correspondence from the parties over the past several days indicating that they have potentially resolved all issues raised in both of these cases. They have jointly requested that the Show Cause Hearing currently scheduled for January 18, 2011 be continued to February 1, 2011 to allow the parties to finalize their agreement. The parties indicated that if the agreement is finalized as anticipated, both cases would be fully resolved without the need for further court intervention. The joint motion to continue the Show Cause Hearing is granted. The hearing is reset to February 1, 2011 at 10:00 AM. The parties shall have until Tuesday, January 25, 2011 to serve and file their witness lists. Minute Entry for proceedings held before Magistrate Judge Tu M. Pham: Status conference held. Counsel for all parties were present and heard. The Magistrate Judge set a Telephone Conference for Monday, December 13, 2010 at 9:00 am (CST) to discuss the entry of a protective order relating to the defendant's financial information. If the parties are able to resolve the protective order issues prior to December 13, 2010 they shall submit the proposed order to the Magistrate Judge promptly. The court set the hearing on the EEOC's motion to show cause for January 18, 2011 at 9:00 AM (CST) in Courtroom 6 - Memphis before Magistrate Judge Tu M. Pham. EEOC's counsel was unavailable until the early part of January and defendant's counsel was unavailable until the week of January 17, 2011. The parties were directed to exchange witness lists by January 11, 2011. The court granted Select's motion for an evidentiary hearing {DE 28} only to the extent the hearing will overlap with the issues raised in the show cause motion. The court will not receive evidence or argument on the motion to dismiss or the motion to strike the declaration of Katharine Kores, as these issues have now been briefed. The court denied Select's request for court ordered mediation but strongly encouraged the parties to discuss a potential global resolution to this case and other pending investigations.
