AGREED FINAL JUDGMENT - Ordered that this Court has jurisdiction over the parties and the subject matter of this action. Dfts admit that their Gas Compressor System, exemplified in Exhibit A, infringes at least Claim 1 of the '434 patent. Dfts represent and warrant that they have made only 5 Gas Compressor Systems that infringe the '434 patent, identified by the serial numbers listed in Exhibiit B, and that dfts agree to cease and desist from making, using, selling and offering for sale, any additional Gas Compressor Systems covered by the '434 patent. To the extent dfts had possession and/or control over any of the Gas Compressor Systems identified in Exhibit B as of 6/30/04, dfts agree to modify those Gas Compressor Systems such that they do not infringe the '434 patent and provide evidence of the modifications. Dfts agree to provide Fluid Compressor with a list of companies dfts provided the infringing Gas Compressor Systems. There shall be no accounting or award of damages to any party and each party is to bear its own costs and atty's fees. This is a Final Judgment.
