ORDER: Pursuant to Special Order No. 3-251, this pro se case was automatically referred for pretrial management, including the determination of non-dispositive motion and issuance of findings of fact and recommendations on dispositive motions. Before the Court is the plaintiff's Notice of Dismissal With Prejudice for Old Republic Surety Company, filed on October 17, 2017 (doc. 10 ). He to seeks to voluntarily dismiss his action against one of the defendants with prejudice. On October 19, 2017, defendant Old Republic Surety Company filed its Stipulation of Dismissal, in which it consented in writing to voluntary dismissal under Fed. R. Civ. 41(a)(1)(A)(ii). Based on the parties' written stipulation, all of the plaintiff's claims against defendant Old Republic Surety Company are deemed to have been voluntarily dismissed with prejudice, and the Clerks Office shall terminate it as a party to this action.
