	ORDER -- Defendants are entitled to summary judgment on Plaintiffs' claims for violation of due process under the Fourteenth Amendment. Claims of excessive force during an arrest or investigatory stop should be analyzed under the Fourth Amendment rather than the Fourteenth Amendment. Defendants' motions for summary judgment on claims that they violated the Fifth Amendment is DENIED. There is evidence from which a reasonable jury could find that the force used in light of the circumstances on the occasion in question was clearly excessive. Officer Kevin Korinek's motion for summary judgment is GRANTED. There is no evidence that Trujillo was hit by a bullet from Korinek's weapon and no evidence that Korinek caused others to inflict injury. Officer Dewayne Griffin's and Gordon Eatley's motion for summary judgment in which they allege that they did not cause pain and suffering to Trujillo and that they were not a contributing cause of his death is DENIED. Questions of fact remain to be resolved. Defendants claim qualified immunity from suit. The resolution of factual issues is necessary to determine whether Defendants are entitled to qualified immunity. Defendants' motion for summary judgment based on qualified immunity is DENIED.
