ELECTRONIC ORDER granting in part and denying in part 4 Defendant R.D. Olson MFG, Inc.'s Motion to Dismiss Plaintiffs' Complaint for Improper Venue Pursuant to Fed. R. Civ. P. 12(b)(3), or in the Alternative, to Transfer Venue Pursuant to 28 U.S.C. § 1404(a). This action stems from an accident in Wheeler County, Texas. That county lies within the territorial confines of the Amarillo Division of the Northern District of Texas. See 28 U.S.C. § 124(a)(5). Plaintiff does not oppose the motion to the extent Defendant seeks to transfer the action. For the convenience of the parties and in the interests of justice, the Court hereby transfers this action to the United States District Court for the Northern District of Texas, Amarillo Division pursuant to 28 U.S.C. § 1404(a). The Court otherwise denies the motion. As argued by Plaintiffs in their response to the motion, venue properly lies in any district in the Northern District of Texas because a substantial part of the events or omissions giving rise to this action occurred in Wheeler County.
