Status conference and Hearing on Motions to Remand held before Magistrate Judge Fidencio Garza Jr Ct Reporter: Gabriel Mendieta, ERO. Status conference held with Ed Stapleton, Frank Costilla, Sam Faddoul and Kevin Glasheen appearing for Plaintiffs and Robert Craig, James Besselman, David Oliveira and Rene Oliveira appearing for Defendants. Court inquired as to the results of the mediation efforts and the parties informed the court that they had failed to settle a single case despite two rounds of mediation that focused on accidental injuries. Court finds that the Motions to Remand need to be addressed first (before Motions to Transfer venue and Motions to Consolidate). Arguments and responses for and against the remand presented. Court finds that the Motions to remand should be granted as to Civil Action No. B-94-82, which includes the 114 cases consolidated with this cause of action, and ordered Plaintiffs' counsel to submit proposed findings of fact and conclusions of law, in support of the order of remand, within 10 days. A status conference on the remaining cases will be set in three months. (mgarza)
