- In consultation with the evaluator, agree on a date and time for the ENE session, taking into account the requirements of Local Rule 16.3(g).
- Discuss compensation with your evaluator. The standard fee under Local Rule 16.3 is $500 per case to be shared equally by the parties. In all cases, fees are to be paid directly to the evaluator. No money should be sent to the U.S. District Court.
- Please take note of the provisions of Local Rule 16.3(h) and (i) with regard to preparation for and conduct of the ENE session.

1. The parties shall serve initial disclosures pursuant to F.R.Civ.P. 26(a)(1) on or before November 18, 2005.
2. The parties shall serve all initial interrogatories and requests for production on or before December 31, 2005.
3. Depositions of all non-expert witnesses shall be completed by June 5, 2006.
4. Plaintiffs shall submit expert witness reports on or before March 1, 2006. Depositions of plaintiffs’ expert witnesses shall be completed by April 1, 2006.
5. Defendants shall submit expert witness reports on or before May 1, 2006. Depositions of defendants’ expert witnesses shall be completed by June 1, 2006.
6. The Early Neutral Evaluation session shall be conducted on February 3,

2006 at 9:30 AM. The parties have agreed that Richard Cassidy, Esq. will serve as the early neutral evaluator.
7. The parties shall serve all requests for admission on or before May 1, 2006.

9. Motions, including summary judgment motions but excluding motions relating to the conduct of the trial, shall be filed on or before July 7, 2006.
