John Franco and I have received the letter you sent earlier this week inquiring about the ENE in this above-referenced case. We have motions pending before the Court to decide a jurisdictional issue, namely whether the case is subject to binding arbitration. The motions are fully briefed and awaiting a decision. In the meantime, John and I filed a Joint and Stipulated Motion to Stay Discovery Schedule on January 23, 2006, pending the resolution of the dispositive motions. It appears that the Court has not acted on our Motion to Stay the Discovery Schedule. Please let me know if anything further is needed.
