	ORDER that upon consent of the parties, the court's findings of fact and conclusions of law, as announced from the bench on 4/13/94, are incorporated herein. Consistent with the findings of fact, the clerk shall enter final judgment on the merits against the pltf., and in favor of the defts., as to all claims in the Amended Complaint. Each party shall bear its own court costs and counsel fees. Each party waives any and all rights to appeal from this order and waives any and all rights to a new trial or to vacate or amend this order. Pltf. hereby releases defts., and defts. release pltf., from any and all claims, known or unknown, arising out of or related to this case. provided however that his release shall not apply to claims that may exist or arise based on any party's conduct after 4/13/94. 	ORDER that for reasons stated from the bench, deft. Biciocchi's renewed motion for summary judgment is denied. The motion may be renewed at trial pursuant to Rule 50 if appropriate. Deft's motion regarding the use of the Duvall deposition and deposition transcript is granted in part and denied in part in accordance with the directions regarding specific page and line numbers given by the Court from the bench. The decision of the Magistrate Judge granting defts. access to pltf's medical records is affirmed in part and reversed in part. The Magistrate Judge's decision is reversed with respect to allowing the inspection of pltf's psychiatric and psychological records. The Magistrate Judge's decision is affirmed in all other respects. Pltf's motion to strike certain witnesses is denied. Counsel for defts. are directed to make these witnesses available at a time and place convenient to counsel for pltf. Further, defts. are directed to bear any deposition costs other thatn attorney's fees, except that defts. have leave to move the court to apportion these costs, or relief defts. from these costs, should the circumstances warrant.
