ORDER that this matter is REMANDED to the United States Patent and TrademarkOffice for Defendant to recalculate the patent term adjustment to which United States Patent Nos. 8,308,558 and 8,328,638 "the '558 and '638 patents" are entitled in light of the Federal Circuit's decision in Novartis AG v. Lee, 740 F.3d 593 (Fed. Cir. 2014). In accordance with this remand,the USPTO shall make a determination under 35 U.S.C. § 154(b)(3)(B), from which the patentee may request reconsideration. In the event that the patentee timely seeks reconsideration, the USPTO's decision on the patentee's request for reconsideration shall be reviewable under 35 U.S.C. § 154(b)(4).
