ORDER - This matter comes before the Court on its own initiative. Pursuant to Federal Rule of Criminal Procedure 5(f) and the Due Process Protections Act, Pub. L. No 116-182, 134 Stat. 894 (Oct. 21, 2020), the Court ORDERS the United States to adhere to the disclosure obligations set forth in Brady v. Maryland, 373 U.S. 83 (1963) and its progeny. Brady v. Maryland instructs that the suppression by the prosecution of evidence favorable to an accused violates due process where the evidence is material either to guilt or to punishment, irrespective of the good faith or bad faith of the prosecution. 373 U.S. at 87. Failure to adhere to this requirement may result in serious consequences, up to and including vacating a conviction or disciplinary action against the prosecution. Having given counsel the oral admonition required by the Due Process Protections Act, this Order serves as the reminder of prosecutorial obligation and duties in accordance with Rule 5(f) and the Eastern District of Virginia Standing Order concerning the same as to 785EEDE. Minute Entry for proceedings held before Magistrate Judge Lawrence R. Leonard:Motion Hearing as to Jamar Green held on 11/4/2019 re 383 First MOTION to Withdraw as Attorney by Adam M. Carroll. Proceedings: Matter came on for hearing on defendants motion to withdraw as counsel (#383). Present were Eric Hurt, AUSA on behalf of the United States, Adam Carroll on behalf of the defendant, and the defendant, in USM custody. Mr. Carroll informed the Court that the defendant will no longer communicate with him and will not meet with him when he attempts to meet with him to discuss his case. Mr. Carroll indicated that he is willing to represent the defendant, but the defendant has made it clear that he no longer wants him to do so. The defendant has also filed numerous pleadings on his own indicating the same thing. The Court attempted to allow Mr. Green to explain what the reason is that he no longer wants to be represented by Mr. Carroll. Mr. Green refused to answer the Courts questions. Based on the interaction with the defendant and the lack of his responses to the Courts questions, the Court could not find that the defendant waived his right to counsel or that Mr. Carroll should be dismissed from the case at this time. The Court found that there was an insufficient basis to grant the motion. Therefore, the motion was DENIED. The Court indicated that motions #385, 386, and 387 filed by the defendant would not be considered as the defendant filed them and not his counsel. The Court will issue an order in this matter. ORDER granting 342 Motion to Continue. In light of the recent superseding indictment and the amount of discovery in this case, the Court grants the motion. However, when counsel was retained, the trial date in this matter was April 30, 2019. The Court now intends to conduct a status conference on this date as all counsel should have such date available, and there are many matters which need to be addressed. The Court has read of the concerns expressed by Mr. Dawson regarding a conflict with another trial in state court.
