JUDGMENT as to Michael D. Hockett (1) count(s) 1: Five (5) Months Imprisonment. Three (3) Years Supervised Release. $100.00 Special Assessment. $20,000.00 Fine. Count(s) 2, 3 -5, 6, 7: Dismissed on Government's Motion. The Court recommends that the deft be incarcerated at a facility as close to the Tidewater Virginia area as possible. The deft shall surrender for service of sentence at the institution designated by the BOP by 2:00 p.m. on 12/27/01 as notified by the USM. Standard conditions of supervised release apply along with the following additional conditions: deft shall not incur new credit card charges or open addtl lines of credit w/out the approval of the PO; deft shall provide the PO w/access to requested financial info.; deft shall perform 200 hours of community service during the period of supervision; deft shall be on home detention, which shall include electronic monitoring at the deft's expense, for a period of 150 consecutive days. During this time, he shall remain at his place of residence except for employment and other activities approved in advance by the PO; he shall maintain a phone at his place of residence w/out party lines, phone answering machines, a modem, "call forwarding," "caller ID," "call waiting," portable cordless phones or any other devices or services that may interfere with the proper functioning of the electronic monitoring equipment for the above period. He shall wear an electronic monitoring device, follow electronic monitoring procedures, and pay the cost of the electronic monitoring, all as directed by the PO; the deft presents a low risk of future substance abuse and therefore, the Court hereby suspends the mandatory condition for substance abuse testing as defind by 18 USC 3563 (a)(5). However, this does not preclude the U.S. Probation Office from administering drug tests as they deem appropriate; as directed by the PO, the deft shall apply monies received from income tax refunds, lottery winnings, inheritances, judgments, and any anticipated or unexpected financial gains to the outstanding court-ordered financial obligation. The fine is due and payable immediately. Any balance remaining unpaid at the inception of supervision shall be paid in installments of not less than $1,000.00 per month, until paid in full. Said payments shall commence 30 days after supervision begins. Deft notified of right of appeal.
