ORDER: On August 18, 2016, the Court ordered expedited briefing on defendants' Rule 12(c) motion. (ECF No. 1052.) The Court is in receipt of the First Level Purchasers' (the "FLPs") August 18, 2016 letter motion for reconsideration, which has been filed under seal (ECF No. 1053), as well as defendants' August 19, 2016 response thereto (ECF No. 1054). The Court declines to reconsider the expedition of briefing. These issues have been well briefed in the past and all that the FLPs need submit is a short piece arguing the effect of the Second Circuit's ruling. That can be done in a few days. We need to resolve this issue one way or the other to move on. Standing is a fundamental question and the defendants' Rule 12(c) motion is by no means frivolous. (Signed by Judge Katherine B. First, there is no basis to suggest that Goldman has possession, custody or control over Evans's personal telephone and the record indicates that the Blackberry device over which it has control did not have the capability enabled. (Representing someone at a deposition does not mean a firm obtains possession, custody and control of all documents and personal devices.) 3. Second, the motion in all events came too late. Goldman's document response (at Ex. A to defendant's opp., and Ex. E of plaintiffs') was served in March 2014 and clearly objects to a general collection of text messages (in the future, this should include not only cost/burden but also possession, custody and control.) That some text messages were produced did not waive this objection as such production was done with an express statement of no waiver. 4. The Court reviewed the statements of Evans at his deposition and he said he texted only rarely for work and there is no indication any relevant texts exist. Aron & Company; Metro International Trade Services LLC; JPMorgan Securities plc; Henry Bath LLC; Glencore Ltd.; and Pacorini Metals USA, LLC, hereby accept service of the FUJIFILM Complaint; 3.
