ORDER: Upon considering the scheduling issues presented by this matter and the conflicting orders issued by the previous judges assigned to this matter, IT IS ORDERED that the Order granting Defendants' Motion for an Extension of Time (Rec. Doc. 39), which was effectively superceded by the September 20, 2013 Order (Rec. Doc. 171), is vacated. IT IS FURTHER ORDERED that the Order accepting the Agreed Scheduling Order (Rec. Doc. 171) is vacated in part. IT IS FURTHER ORDERED that: 1. On or before October 28, 2013, the Defendants shall file their response(s) to the Plaintiffs' Motion to Remand. The Defendants shall coordinate their efforts to file a consolidated response to the extent possible in order to avoid multiple briefs being filed, reserving unto any Defendant the right to file a separate brief to the extent that it does not concur in the consolidated response; 2. On or before November 6, 2013, the Plaintiffs shall file their reply, if any, to the Defendants' response(s) in opposition to the Motion to Remand. In the event that Defendants are unable to sufficiently coordinate their efforts to file a consolidated response to the extent possible, Plaintiffs reserve the right to seek relief from this Order in order to allow additional time for Plaintiffs to file their reply; 3. The issues will be fully briefed in time for a special sitting by the Court on November 13, 2013 as a submission date. If any party desires argument on the Motion to Remand, it will submit an appropriate request in accordance with the Local Rules; 4. Defendants will not be required to file Answers or Motions to Dismiss, or otherwise to respond to Plaintiffs' Petition/Complaint, until after the Court issues its ruling on the Motion to Remand; 5. In the event the Court denies Plaintiffs' Motion to Remand, a Status Conference will be set by the Court to establish a briefing schedule with respect to filing responsive pleadings, including Rule 12 motions. IT IS FURTHER ORDERED that the remainder of the September 20, 2013 Order (Rec. Doc. 171) is suspended, pending discussion in the aforementioned status conference.
