Chen on 3/17/16 in Case No. 11-CV-3180: Appearances by Andrew Hoffmann for Plaintiff in 11-CV-3180; non-party Stephanos Zannikos; Meredith Friedman for Defendant in 11-CV-3180. Case No. 11-CV-3180 called. Discussion held. The Court initially questioned Mr. Hoffmann about his representation in a letter 48 filed yesterday in this case, 14-CV-517, that he had "never" received ECF/email notification of three of the Court's orders in this case. In response to the Court's questions, however, Mr. Hoffmann admitted that he only "believed" that to be the case and that he had not checked his email account prior to filing the letter to verify this representation to the Court. The Court also questioned Mr. Hoffmann about why, in Case No. 11-CV-3180, he had failed to respond to Defendant's edits to a settlement agreement, which were transmitted to Mr. Hoffmann four months ago. Mr. Hoffmann acknowledged that he had been delinquent in this regard, and had no excuse other than that he has been experiencing personal issues that have caused him to be less than diligent with respect to his cases. The Court also noted other instances of Mr. Hoffmann's failure to notice his appearance, see, e.g., Case No. 15-CV-2378, or to comply with a court order, see, e.g., Case Nos. 15-CV-2378, 14-CV-517. The Court advised Mr. Hoffmann that, though it had initially considered referring Mr. Hoffmann to the Eastern District's internal disciplinary committee for this and other failures, it had reconsidered doing so at this time, based on Mr. Hoffmann's statements acknowledging the impropriety of this conduct and expressing contrition for what he described as a period of aberrant conduct by him.However, Mr. Hoffmann is directed to file a notice of appearance in Case No. 11-CV-3180 today, 3/17/16, as well as notices of appearance in any other cases pending in this District in which Mr. Zannikos, prior to his departure from Mr. Hoffmann's firm, was the only associate who entered an appearance. Mr. Zannikos is directed to file notices of withdrawal in all cases in which he has appeared for Hoffmann & Associates, including Case Nos. 15-CV-2378, 15-CV-1450, and 15-CV-1449.
