As Defendant Fox has not purged himself of contempt pursuant to the Court's minute entry dated 10/05/2016, the Court dismisses Fox's remaining counterclaim against Plaintiff Simons. The Court holds in abeyance its order that Fox pay $500 a day for each day that he remains in contempt, given that he has now filed a sworn affidavit stating he is impecunious. Simons may attempt to pursue through discovery any of Fox's assets potentially available to satisfy the sanctions. For the reasons stated in open court, Plaintiff Simons' Motion to to Hold Defendant Fox in Civil Contempt of Court [ECF No. 181] is granted in part, and Defendant Fox's Motion to to Stay [ECF No. 198] is denied. The Court hereby holds Joseph Fox in civil contempt of court for continued refusal to comply with the Court's sanction orders dated May 2, 2016 and August 11, 2016. Beginning on October 6, 2016, the Court will fine Fox $500 per day for each day that he remains in contempt. To be purged from contempt, Fox must pay the attorneys' fees award ordered on August 11 in the amount of $44,681.50. Failure to do so by November 4, 2016 will result in dismissal of Fox's counterclaim and the Court's consideration of a term of confinement.
