Kendall:Status hearing held and continued to 3/3/2009 at 09:00 AM to set a Markman Hearing date and report on whether the parties wish a settlement conference. Court adopts the plaintiff's discovery, claim construction, dispositive motion, pretrial order, and trial schedule. The parties shall exchange preliminary claim constructions by 2/2/2009. The parties shall meet and confer pursuant to paragraph 2 of this court's standing order by 2/16/2009. The parties shall submit the joint claim construction chart by 2/23/2009. Plaintiff's claim construction brief is to be filed by 3/16/2008. Defendant's claim construction brief is to be filed by 4/6/2009. Reply is due 4/20/2009. The final joint claim construction chart is to be submitted by 4/27/2009. The party with the burden of proof shall comply with FRCP(26)(a)(2) by 5/11/09. Rebuttal disclosures and reports shall made by 5/26/09. All expert discovery shall be completed by by 6/22/2009. All dispositive motions with supporting memoranda shall be filed by 7/27/2009. Responses are to be filed by 8/17/2009. Replies due by 8/24/2009. Court will rule by mail. The parties are to submit the joint final pretrial order due by 9/28/2009.
