	ORDER as to Dayton Poke : Defendant has filed two motions for reduction of sentence 231 232 which are identical and the court will therefore strike 231 in favor of 232 . Pursuant to Castro v. United States, 540 U.S. 375, 383 (2003), this court is now advising defendant of this court's intent to characterize the motion as one under § 2255 and warns defendant that this characterization will subject any subsequent § 2255 motion to the restrictions applicable to second or successive § 2255 motions, see 28 U.S.C. § 2255(h). This court further advises defendant that he has the opportunity to withdraw the motion, if he does not want it to be considered a motion under § 2255, or to amend it to include every § 2255 claim that he believes that he has, which must be done within 30 days of this order. If defendant neither withdraws or amends his motion, the court will proceed with its Rule 4 initial review of the motion as it stands. The clerk is directed to open a civil case and file defendant's motion 232 as a motion brought pursuant to 28 U.S.C. § 2255. All future filings will be in the civil case. In the motion, counsel indicates that she needs to review all records placed under seal or not included in the Circuit Court file and those records maintained by the Winnebago County Sheriffs Department. It is unclear, however, why these documents would be relevant. Under the categorical approach, we consider the offense generically; we may not inquire into the specific conduct of a particular offender. United States v. Smith, 544 F.3d 781, 786 (7th Cir. 2008). Although the inquiry may be expanded to a limited range of additional material if the statute is divisible (which it is but is answered by the indictment which the government has provided), the court is still prohibited from determining whether the actual conduct of the defendant (as opposed to what defendant is charged with) constitutes purposeful, violent, and aggressive acts for purposes of the ACCA. Accordingly, counsel is directed to file a supplemental memorandum by the end of the dayclarifying what documents she needs to obtain in order to file her response.
