ORDER: On June 3, 2016, the Court issued an Order directing the parties to file a joint letter (1) addressing whether they agree with the Court's view that Plaintiffs are not entitled to unilaterally file an interlocutory appeal from the Court's April 28, 2016 Order pursuant to 28 U.S.C. § 1292(a)(1), and instead must first seek and obtain the Court's approval to file an interlocutory appeal pursuant to 28 U.S.C. § 1292(b); (2) advising the Court as to whether either party wishes to pursue an interlocutory appeal pursuant to 28 U.S.C. § 1292(b); and (3) apprising the Court as to whether the parties wish to have this case referred to Judge Peck for a settlement conference. (Doc. No. 369.) The Court is now in receipt of the parties' joint letter, dated June 8, 2016. (Doc. No. 371.) In the letter, Plaintiff's state that they disagree with the Court's view on the interlocutory appeal issue and that therefore they will continue to unilaterally pursue their interlocutory appeal under 28 U.S.C. § 1292(a)(1). For their part, Defendants assert that they have no intention of pursuing an interlocutory appeal from the Court's April 28 Order and that neither party should be allowed to pursue any appeal until the Court issues a final judgment in this case. As for the referral issue, while Plaintiffs are willing to engage in settlement discussions before Judge Peck, Defendants are not. In light of the fact that neither party is interested in pursuing an interlocutory appeal from the April 28 Order pursuant to 28 U.S.C. § 1292(b), and that, as Plaintiffs indicate, it is ultimately for the Court of Appeals for the Second Circuit to determine whether it has appellate jurisdiction to review Plaintiffs' interlocutory appeal of that Order under 28 U.S.C. § 1292(a)(1), the Court will not disturb its June 3 Order granting the parties' joint request to stay these proceedings pending resolution of Plaintiffs' interlocutory appeal. (See Doc. No. 369; see also June 3, 2016 Tr. at 11-13.) As for referring this case to Judge Peck for settlement purposes, the Court declines to do so given Defendants' clear statement that they currently have no interest in participating in settlement discussions. Should Defendants' position change, the parties should jointly submit a letter to the Court renewing a request for referral. Pursuant to the Court's June 3 Order (see Doc. No. 369), the parties are reminded that, by August 3, 2016, they shall jointly file a letter apprising the Court as to the status of this case, including with respect to Plaintiffs' interlocutory appeal and settlement, however unlikely. In addition, IT IS FURTHER ORDERED THAT, within twenty-four hours of the Circuit's ruling resolving Plaintiffs' interlocutory appeal (either on the merits or, as the Court believes is more likely, by denying the appeal on jurisdictional grounds), the parties shall jointly file a letter apprising the Court of the Circuit's ruling and proposing next steps. ORDER: On April 28, 2016, the Court issued a Memorandum and Order resolving Plaintiffs' due process claims and scheduled a status conference to discuss outstanding issues in this case. (Doc. No. 366 (the "April 28 Order").) On May 24, 2016, Plaintiffs filed a Notice of Interlocutory Appeal from the April 28 Order. (Doc. No. 367.) On May 27, 2016, the parties filed a joint letter setting forth proposed next steps in this case, including Plaintiffs' request for a stay of this action pending resolution of their interlocutory appeal. (Doc. No. 368.) On June 3, 2016, the Court held a status conference. Accordingly, for the reasons stated on the record, IT IS HEREBY ORDERED THAT this action shall be STAYED pending resolution of Plaintiffs' interlocutory appeal of the Court's April 28 Order. However, as noted on the record, the Court remains unsure as to what basis exists for Plaintiffs' automatic filing of an interlocutory appeal. Accordingly, for the reasons set forth above and those stated on the record, IT IS FURTHER ORDERED THAT, by June 6, 2016, the parties shall jointly file a letter (1) addressing the interlocutory appeal issues discussed above, including whether Plaintiffs agree that they must pursue any such appeal under 28 U.S.C. § 1292(b) (as opposed to 28 U.S.C. § 1292(a)(1)), (2) advising the Court as to whether either party wishes to pursue an interlocutory appeal pursuant to 28 U.S.C. § 1292(b), and (3) apprising the Court as to whether the parties wish to have this case referred for settlement purposes to Magistrate Judge Andrew J. Peck or to the Court-annexed Mediation Program. In addition, in light of the fact that this action is now stayed pending resolution of Plaintiffs' interlocutory appeal, IT IS FURTHER ORDERED THAT, by August 3, 2016, the parties shall jointly file a letter apprising the Court as to the status of this case, including with respect to settlement and Plaintiffs' appeal. MEMORANDUM AND ORDER: Collectively, this Memorandum and Order and the Findings of Fact form the Court's bench opinion as to Plaintiffs' constitutional claims. For the reasons set forth below, the Court finds that the notice provided by the TLC with respect to summary post-suspension hearings held prior to December 2006 violated the procedural component of the Due Process Clause of the United States Constitution. In all other respects, the Court finds that Plaintiffs have failed to prove their constitutional claims. For the reasons set forth above, the Court finds that, with the exception of the notice provided to Plaintiffs prior to December 2006, Plaintiffs have failed to sustain their burden of proof with respect to their due process claims. IT IS HEREBY ORDERED THAT, by May 27, 2016, the parties shall file a joint letter setting forth their positions as to the next steps required in this action with respect to damages, attorneys' fees, and Plaintiffs remaining state law claims. With respect to Plaintiff Karmansky, who has died, and Plaintiff Nnebe, who no longer wishes to serve as a class representative, the only issue now is whether they will remain as named plaintiffs. Issues of class representation and membership in the class will be addressed if and when class certification is reached. Should Plaintiff Karmansky's estate wish to pursue this action as a named plaintiff on behalf of plaintiff Karmansky, they shall make a motion pursuant to Federal Rule of Civil Procedure 25(a)(1) no later than January 8, 2014. Similarly, Plaintiff Nnebe should advise the Court no later than January 8, 2014 as to whether he intends to proceed as a named plaintiff. To the extent he does wish to continue serving as a named plaintiff, then he must be available to testify at trial. In any event, whether Plaintiffs Nnebe and Karmansky continue as named plaintiffs or not, the scope of the trial remains unchanged and shall be limited to determining what standard ALJs and the TLC Chair applied in 2006 and what standard they apply today. ORDER: Now before the Court are the parties' motions in limine. (Doc. Nos. 230, 233, 235.) The Court will rule on these motions at the pretrial conference scheduled for Friday, December 20, 2013. Before that conference, however, the Court must resolve a major dispute between the parties: what question this trial is meant to answer. Plaintiffs argue that the trial should address almost all open questions in this case, including whether Defendants provide adequate notice to affected drivers, whether the post-deprivation proceedings violate due process, and whether the administrative tribunals were systematically biased. (Doc. No. 242 at 2-3.) Defendants, on the other hand, argue that the trial should address the narrow question of what standard is applied at post-suspension hearings. (Doc. No. 237 at 2.) The Court holds that only the narrow question is currently at issue. This trial is part of the first step, and as such it is focused solely on "whether the post-suspension hearing the City affords does indeed provide an opportunity [both de jure and de facto] for a taxi driver to assert that, even if the criminal charges are true, continued licensure does not pose any safety concerns." (Id.). The parties should tailor their arguments going forward, at least until the trial is completed, to focus on this issue alone. SO ORDERED. (Signed by Judge Richard J.
