King: The Court, after review of the entire record, and after considering all papers filed and proceedings held in connection with the Agreement, including the fairness hearing held on January 14, 2013, has determined that the settlement should be APPROVED. 1. The Court has jurisdiction over the subject matter of this litigation, and all actions within this litigation and over the parties to the Agreement, including all members of the class on the one hand, and defendant the United States of America on the other. 2. The Court hereby finally APPROVES and CONFIRMS the settlement set forth in the Agreement and finds that said settlement is, in all respects, fair, reasonable, and adequate to the class, pursuant to Rule 23 of the Federal Rules of Civil Procedure. 3. MINUTES OF TELEPHONIC STATUS CONFERENCE held before Judge George H. King: Court conducts telephonic status conference with counsel regarding status of settlement discussions. Counsel represent that they are optimistic that there will be a settlement, pending Homeland Security approval of the latest iteration of the agreement. Court directs counsel to file a joint status report once Homeland Security has acted, but in no event later than June 15, 2012. If the settlement is approved by Homeland Security, counsel shall set forth the steps that would have to be taken before final settlement approval and a proposed timetable therefor. If Homeland Security has not yet acted by June 15, 2012, defendant's counsel shall set forth an estimate of the time needed for Homeland Security to act. MINUTES (IN CHAMBERS) ORDER re: Plaintiffs' Motion to Certify Category 3 Subclass by Judge George H. King granting in part and denying in part [231] Motion to Certify Class Action: For the foregoing reasons, we hereby GRANT Plaintiffs' Motion to Certify a Category 3 Subclass as defined above. However, Plaintiffs' request for an "open" Category 3 subclass is DENIED. Because we have already granted remand with instructions to determine Category 3 Subclass naturalization applications within 60 days of this Order, relief has already been afforded to the Category 3 Subclass. The Category 3 Subclass claim has now been disposed of, and because the named Plaintiffs have been granted all the relief afforded to them as a Category 3 subclass member, they no longer have standing to represent, or an interest in representing, any future subclass members. See Newberg § 3:7 (explaining reasons for denying an "open" class). Pursuant to § 1447(b), any future potential subclass members should bring their Category 3 claim in the district of their residence. Pursuant to this Order, and our March 31, 2009 Order, we hereby REMAND all Category 3 claims for all Category 3 subclass members currently before us to USCIS, with instructions to either grant or deny all Category 3 subclass members' naturalization applications within SIXTY DAYS hereof. MINUTES (IN CHAMBERS) ORDER re: (1) Defendant's Motion to Dismiss in Part, Remand in Part, and Stay in Part, (2) Plaintiffs' Motion to Certify Two Subclasses [233] by Judge George H. King: Defendant moves to dismiss claims Seven and Eight of Plaintiff Chih Ling Chou under the doctrine of res judicata or on the grounds of mootness. Plaintiff does not object to this dismissal. Accordingly, Plaintiff Chih Ling Chou's Category 2 claims, claims Seven and Eight, are hereby DISMISSED. Accordingly, Defendant's request for a sixty-day stay for all Category 2 claims is hereby GRANTED. The Parties are hereby ORDERED to provide a joint status report regarding the naturalization applications of the Category 2 Plaintiffs within FOURTEEN DAYS after the completion of the sixty-day stay. We caution Defendant not to request a further stay unless it can show good cause for why the stay should be extended. The sixty-day stay commences as of the date of this order. Accordingly, Defendant's request to dismiss the 15 named Category 3 Plaintiffs not residing in the Central District of California is hereby GRANTED and those 15 named Category 3 Plaintiffs' claims are hereby DISMISSED without prejudice to our consideration of their claims as potential members of any subclass that might be certified. Accordingly, we hereby REMAND all Category 3 claims currently before us to USCIS, with instructions to either grant or deny all Category 3 Plaintiff naturalization applications within SIXTY DAYS. This order does not take effect until the Parties submit the joint brief, as discussed infra, and a ruling is made pursuant to that joint brief. Plaintiffs request that we certify a Category 2 subclass. Because we have already stayed all Category 2 claims, we hereby DENY Plaintiffs' Motion to certify a Category 2 subclass without prejudice pending further proceedings, if any, after expiration of the sixty-day stay. If Plaintiffs' request to certify a Category 2 subclass is not made moot by Defendant's action, Plaintiffs may re-file their motion to certify a Category 2 subclass at that time. Given our order remanding all remaining Category 3 named plaintiffs' cases back to USCIS with instructions to determine their naturalization application within sixty days, it is unclear whether Plaintiffs still wish to certify a Category 3 subclass comprising the remaining 15 Category 3 potential subclass members who do not reside in the Central District of California. Plaintiffs SHALL meet and confer with Defendant, file a joint status report within FOURTEEN DAYS informing the court whether Plaintiffs still seeks to certify a Category 3 subclass given the Court's orders, and if so, whether Defendant opposes such a subclass, given that we are inclined to remand any subclass under the same terms as we have stated we would do with respect to the three Category 3 Plaintiffs who reside in this district.
