The parties are reminded that it is improper to seek relief by simply sending emails to the Proposed Order mailbox. The proper way to raise a request for relief is by filing a written motion or requesting a Court hearing for an oral motion. Notwithstanding the procedural irregularities, the Court has reviewed the substance of the parties' correspondence. The Court notes that Plaintiffs did not raise their requested change during the hearings on the jury instructions. After reviewing the proposed change, the Court overrules Plaintiffs' objection to the jury instructions that were given. Plaintiffs' motion in limine #4 147 is denied. Defendant may present evidence indicating that Defendant went out of business, as it is relevant to the issue of punitive damages. However, Defendant should take care to avoid unnecessary, duplicative, or cumulative evidence on Defendant's financial condition. Defendant's motion in limine #4 143 is granted. Defendant's motions in limine #9, #10, #15, #16, #17 (seeking to exclude evidence of alleged sexist language and acts by Plaintiffs' coworkers), #11 (seeking to exclude a number of statements as inadmissible hearsay), #19 (seeking to exclude evidence of damages relating to Plaintiff Wilson's retaliation claim) 143 are denied. The Parties have also raised numerous objections to documentary exhibits. Based on the current record, the Court cannot find that any of the exhibits are irrelevant, and therefore the parties' objections on the basis of relevance are overruled, without prejudice to the Parties' ability to renew their objection at trial. Under Federal Rule of Civil Procedure 54(b), when an action presents more than one claim for relief or when multiple parties are involved, any order or other decision, however designated, that adjudicates fewer than all the claims or the rights and liabilities of fewer than all the parties does not end the action as to any of the claims or parties and may be revised at any time before the entry of a judgment. As the Court's grant of summary judgment as to the claims against Defendant The Packer Group, Inc. did not adjudicate all the claims or the rights and liabilities of all the parties, this action remains pending and no judgment within the meaning of Rule 54 has been entered against The Packer Group or any other party. Accordingly, Defendants' bill of costs is premature under Local Rule 54.1, which permits the prevailing party to file a bill of costs within 30 days of the entry of a judgment. Similarly, Defendants' motion for attorney's fees is premature under Federal Rule of Civil Procedure 54(d)(2)(B)(i), which allows a claim for attorney's fees to be made by a motion filed no later than 14 days after the entry of judgment. Further, Local Rule 54.3 sets forth a procedure for a fee motion seeking an award of attorney's fees, with which Defendants have apparently failed to comply. Finally, the Court notes that the papers submitted by The Packer Group provide no apparent means to distinguish between costs and attorney's fees incurred in defense of The Packer Group as opposed to costs and attorney's fees incurred in defense of Packer Engineering, Inc., against which the case remains pending. For example, among the costs listed in The Packer Group's bill of costs are costs associated with deposing the plaintiffs. One would expect those depositions to be highly relevant to the claims against Packer Engineering, Inc. and therefore the extent to which they are recoverable may be impacted by the resolution of the claims against that defendant.
