PRELIMINARY APPROVAL ORDER - WHEREAS, the Court has been advised that the Parties to this action, Jeffrey S. Ridenour and Amin Halem, and Sterling Infosystems, Inc., through their respective Counsel, have agreed, subject to Court approval following notice to the Settlement Class Members and a hearing, to settle the above captioned lawsuit upon the terms and conditions set forth in the Settlement Agreement. The Settlement Agreement has been filed with the Court and the definitions set forth in the Settlement Agreement are incorporated by reference herein. Based upon the Settlement Agreement and all of the files, records, and proceedings herein, it appears to the Court that, upon preliminary examination, the proposed settlement is fair, reasonable, and adequate. A hearing will be held on July 19, 2017, at 10:30 A.M., after notice to the proposed Settlement Class Members to confirm that the proposed settlement is fair, reasonable, and adequate, and to determine whether a Final Approval Order should be entered in the Litigation. ORDER - This matter is before the Court on a consent motion, memorandum in support, proposed preliminary approval order, and supplemental proposed preliminary approval order, collectively seeking: (1) preliminary approval of a class action settlement; (2) conditional certification of two proposed classes; (3) appointment of class counsel and approval of a settlement administrator; (4) approval of the proposed "notices" to be sent to members and potential members of the two classes; and (5) the scheduling of a final fairness hearing. ECF Nos. 167 , 168 , 171 . Such filings address the claims advanced by plaintiffs Jeffrey Scott Ridenour and Amin Halem, and all others similarly situated, against defendant Sterling Infosystems. Inc. Upon review of the filings and revised filings, the Court finds that the parties have demonstrated that preliminary approval is appropriate in this case. Accordingly, a detailed Order granting the consent motion will follow entry of the instant Order. The Court will inquire into the final language used in the notices at the July 19, 2017, fairness hearing to ensure that class members received notices that fairly, accurately, and clearly informed them of their rights in this case. The Court highlights these matters at the outset in an effort to ensure that the most efficient process is used for providing clear notice to the class members and potential class members. (See order for specific details) Copies distributed to all counsel. Signed by District Judge Mark S. Davis on 2/14/2017. (cchr) (Entered: 02/15/2017)

ORDER - This matter is before the Court on a consent motion, and supplemental consent motion, seeking: (1) preliminary approval of a class action settlement; (2) conditional certification of the proposed class; (3) appointment of class counsel; (4) an order directing that notice be mailed to individual class members; and (5) the scheduling of a final fairness hearing. ECF Nos. 138, 145. Upon review of the revised motion, revised memorandum in support, first revised stipulation of settlement, and revised proposed notice to class members, the Court finds that the parties have demonstrated that preliminary approval is appropriate. Accordingly, a detailed order granting the proposed supplemental motion will follow entry of this Order. ORDER - This matter is before the Court on a consent motion seeking: (1) preliminary approval of a class action settlement; (2) conditional certification of the proposed class; (3) appointment of class counsel; (4) an order directing that notice be mailed to individual class members; and (5) the scheduling of a final fairness hearing. Such motion addresses the claims advanced by plaintiff Jeffrey Scott Ridenour, and others similarly situated, against defendant Multi-Color Corporation. It does not involve the claims by Ridenour, plaintiff Amin Halem, and/or those similarly situated, against Defendant Sterling Infosystems Inc. Upon review of the motion, memorandum in support, stipulation of settlement, and proposed notice to class members, the Court believes that the parties have made a strong showing in support of preliminary approval and the associated rulings requested in the consent motion. However, the Court has identified several issues to be addressed prior to the Court's entry of an Order granting the consent motion. (See Order for Specific Details). Counsel for both parties are INSTRUCTED to confer in a timely manner. After such conference, counsel should submit whatever supplemental/amended motions, briefs, or other filings they deem necessary. Such supplements shall be filed within twenty-one (21) days of the date of this Order. Copies distributed to all counsel of record. Signed by District Judge Mark S. Davis on 8/25/2016. MEMORANDUM ORDER - After reviewing four of the documents, and considering the parties' briefing and oral argument, as well as the terms of the Protective Order, the court FINDS that, as redacted, the challenged documents are not entitled to even the limited protection conferred by the Order. However, if Sterling desires to maintain their confidential designation for purposes of discovery, it may produce unredacted copies. Accordingly, the court GRANTS IN PART and DENIES IN PART the motion to maintain the designation. Accordingly, as to all of the 206 redacted documents, Sterling is ORDERED to either produce the documents in unredacted form subject to the terms of the Agreed Protective Order, or de-designate the redacted document as no longer subject to its terms. Upon receipt of unredacted documents subject to the terms of the Order, Plaintiffs shall meet-and-confer as required by paragraph 8 of the Order prior to presenting further motions. Sterling's Motion for a Protective Order to Maintain a Confidential Designation (ECF No. 96) is GRANTED IN PART and DENIED IN PART. Any document for which Sterling seeks to maintain its discovery protection must be produced in unredacted form, subject to the terms of the Order. The court will separately evaluate the necessity of extending the protection conferred by the Order in the event any designated document is proffered as part of the proceedings in this action. Copies distributed as directed. Signed by Magistrate Judge Douglas E. Miller on 7/27/2016. (cchr) (Entered: 07/27/2016)

ORDER re 92 MOTION to Strike Objections and Compel Discovery Responses And Deposition Testimony as to Defendant Sterling Infosystems, Inc. The court GRANTS IN PART and DENIES IN PART Plaintiffs' Motion (ECF No. 92). The court DENIES Plaintiffs' request to strike Defendant's objections to Plaintiffs' Requests for Production of Documents. The court GRANTS Plaintiffs' Motion as follows. Specifically, the court GRANTS Plaintiffs' request for the production of documents related to Defendant's liability insurance policies, as set forth in Request for Production No. 7, (ECF No. 93-1, at 5), and ORDERS Defendant to produce copies of these policies by Monday, August 1, 2016. MEMORANDUM ORDER granting in part and denying in part 21 Motion to Dismiss Counts I, II, III, V, and VI of Plaintiff's Complaint by Sterling Infosystems, Inc. Sterling's motion is DENIED in all respects with the exception of the following: (1) Count Five is dismissed in full; and (2) the portions of Counts One and Two that purport to assert that Sterling willfully violated § 1681b(b)(3) are dismissed. Such dismissals are without prejudice to Plaintiff's right to file a formal motion seeking leave to file an amended complaint. If Plaintiff elects to file such a motion, it shall be filed no later than December 14, 2015, and should be accompanied by a supporting brief, which includes as an exhibit Plaintiff's proposed amended complaint. If Plaintiff elects not to pursue amendment within the time-period set forth herein, the partial dismissals without prejudice shall become dismissals with prejudice, and Sterling shall have until December 31, 2015, to file a responsive pleading.
