Attorneys Randall Edwards and Edmundo Clay Marquez appeared by telephone on behalf of Defendant. Attorney Shannon Cox appeared by telephone on behalf of Home Depot. Attorney Torsten Kracht appeared by telephone on behalf of Lowe's. For the reasons discussed during the hearing, the motion to compel Home Depot 125 is terminated without prejudice, in light of the forthcoming production. With regard to Lowe's, Lowe's reported that the 5-digit invoice numbers are comprised of checkout register numbers (the first two digits) and sequential sales numbers (the other three digits), so the invoice numbers are not on their face necessarily tied to a specific store, and duplicates appear because the last three digits turnover after 999 sales are made at that register. It is possible to use the invoice numbers to perform further research for specific information, but it is not yet clear (a) what the burden would be to do so and (b) whether the research would generate a definitive answer to whether XPO was engaged to perform the delivery. As a next step, the Court ordered Lowe's to research five invoice numbers, and by 07/14/2017, Lowe's shall provide the results (including informatnio on the consumption of time and resources to perform the research) to Plaintiff and Defendant. Lowe's shall confer with both Plaintiff and XPO. After the conferral, if Lowe's is willing to have a records custodian sit for a deposition, then the deposition shall be scheduled at everyone's convenience. But if Lowe's objects to the deposition, then Lowe's shall file a response to the motion to compel 123, by a deadline to be set at the next status hearing. With regard to expert discovery, Plaintiff shall take the deposition of Defendant's disclosed expert by 08/07/2017. The deadline for Plaintiff to decide whether to disclose a responsive expert is 08/21/2017. If an expert is going to be disclosed, then the date for disclosing the expert is 09/18/2017. With regard to Home Depot 125, Home Depot shall further investigate the production of the subpoenaed information, and Home Depot shall confer with both parties again by 06/27/2017. Based on the conferral, Plaintiff and Defendant shall file a status report on 06/30/2017, but the parties shall provide a draft of the status report to Home Depot by 9 a.m. on 06/29/2017, so that Home Depot may comment on it (if full-blown briefing is needed, then the Court will set that schedule at the next status hearing). With regard Lowe's 123, Lowe's shall confer with XPO in the upcoming days, and then Lowe's shall confer with both Plaintiff and XOP on 06/27/2017. As with Home Deport, based on the conferral, Plaintiff and Defendant shall file a status report on 06/30/2017, but the parties shall provide a draft of the status report to Lowe's by 9 a.m. on 06/29/2017, so that Lowe's may comment on it (again, if full-blown briefing is needed, then the Court will set that schedule at the next status hearing). Hearing on both motions [123, 125] are continued to 07/07/2017 at 9:45 a.m. On both motions, it might become necessary to take 30(b)(6) depositions to explore the feasibility of production, but hopefully it will not come to that. The expert disclosure deadline of 07/03/2017 for Plaintiff's call-data analysis is suspended, but the defense industry practices expert (which is unaffected by the pending subpoenas) shall still be disclosed by that deadline. On the public record, the Court stated the reasons for adopting the following schedule: production from Defendant of IKEA-related call data, customer facing documents, consent policies, and call scripts due 06/30/2016. Production from Defendant of non-IKEA call scripts, customer facing documents, and consent policies due 07/20/2016. Production of non-IKEA call data is set for 08/22/2016. By 07/25/2016, the parties shall file a joint status report detailing the progress of discovery and describing any disputes, with concrete information. Any conferrals on the details of retrieving call data shall include the respective sides' non-lawyer employees/vendors/experts for direct discussion. Over Plaintiff's objection, the parties are authorized to engage in discovery as to independent-contractor delivery non-parties.
