MEMORANDUM DECISION & ORDER: Under these unusual circumstances, it is appropriate to preclude the testimony of Smeland, Murphy and Jones. It is additionally appropriate to make an adverse inference as to the intent of Smeland and Murphy. Only this inference, which is "the single most reasonable inference able to be drawn from the evidence", is sufficient to remedy the array of issues discussed above and to place the prejudiced party, Merus, in a position as near as possible to that which it would occupy in the absence of the misconduct. See Therasense, 649 F.3d at 1290 (quoting Star Scientific Inc. v. R.J. Reynolds Tobacco Co., 537 F.3d 1357, 1366 (Fed. Cir. 2008)); Residential Funding Corp. v. DeGeorge Financial Corp., 306 F.3d 99, 108 (2002). The application of these inferences to the Court's prior finding of materiality appears to lead inexorably to one final determination: that Regeneron engaged in inequitable conduct in connection with the prosecution of the '018 Patent. Should the parties disagree that this inference requires such a finding, they shall make a submission on such position not later than August 25, 2015. As a final matter, the Court notes the application by Regeneron to enjoin Merus counsel exposed to Regeneron documents on the log from undertaking certain work and for certain other relief. This application is wholly without merit as further set forth in this order. In light of the remedies on the merits set forth above, the Court sees no need to order this additional relief. The Court will issue a full written opinion on materiality and inequitable conduct as soon as practicable (but very likely not before mid to late September). MEMORANDUM DECISION & ORDER: granting in part and denying in part 255 Motion to Compel; denying 255 Motion for Sanctions. Merus has now moved for an order imposing sanctions on Regeneron in the form of an adverse inference at trial for its failure to comply with the Court's December 5 Order. (ECF No. 255.) Regeneron opposes that motion on the alternative bases that it has fully complied with that Order or, if it has not, that its failure to do so was a reasonable dispute as to scope and does not merit the imposition of sanctions.This Court DENIES Merus's motion for the imposition of sanctions. The Court views this matter as mainly a good-faith dispute over the scope of the Court's December 5 Order. A motion for sanctions would be an unnecessarily extreme remedy in this case. Both parties are incorrect as to the scope of the Court's Order Merus seeks more, but Regeneron may have produced less than the Court intended. Accordingly, Merus's motion to compel additional production is GRANTED in part and DENIED in part. And as set forth herein. The Court assumes that with this guidance the parties may determine whether there are additional materials Regeneron should produce. ORDER: On December 11, 2014, the Court set forth in an order: "Merus shall file a letter regarding the continuation of discovery not later than December 22, 2014." (ECF No. 232.) As discussed in the status conference on December 10, 2014, the Court intended for Merus to explain why discovery related to inequitable conduct should continue, regardless of the outcome of Regeneron's proposal that all remaining defenses be dismissed with prejudice or stayed pending an appeal of the claim construction decision. (Tr. at 20, ECF No. 239.) Instead, Merus submitted a letter listing its complaints with Regeneron's effort to "stonewall discovery," "violate[ ] the court's waiver order" and "misrepresent[ ] facts." (ECF No. 242.) As Regeneron set forth in their letter (ECF No. 245), Merus's letter is not compliant with the Court's Order asking for argument as to why discovery on this matter should continue. Jones. Dr. Jones is an attorney with the law firm Foley Hoag, who acted as a patent agent in prosecuting the U.S. Patent No. 8,502,018 ("'018 Patent"). (ECF No. 203.) DISCOVERY ORDER #8: Accordingly, the parties shall proceed as follows with regard to the Document: 1. Defendants shall question Murphy at his deposition regarding the events relating to the invention set forth in the '018 Patent. 2. Defendants may retain copies of the Document until the conclusion of the deposition, as set forth below. 3. If during the deposition, defendants establish that Murphy's testimony reflects a recollection materially different from that set forth in the Document, the defendants may mark the Document and proceed to further examine Murphy regarding its contents. 4. If Murphy's testimony does not reflect a materially different recollection of events from that set forth in the Document, defendants shall have no need for the Document and shall be able instead to use the content of the deposition transcript for all purposes. ORDER: the parties shall next appear before the undersigned at the Markman hearing scheduled for September 12, 2014. DISCOVERY ORDER #5: The Court has received letter motions from both Merus B.V. ("Merus") and Ablexis LLC ("Ablexis") (together, "defendants") relating to plaintiff Regeneron Pharmaceuticals, Inc.'s ("Regeneron") conduct regarding claim construction. Defendants seek an Order precluding Regeneron from asserting any proposed construction or, alternatively, to comply with the Court's Individual Patent Rules 2(a). Regeneron opposes defendants' request.... The Court's rules relating to claim construction should be interpreted according to their terms, according to routine civil practice, and according to what is plainly fair. The Court is troubled by assertions that there is a "gaming" of the system. Let's be clear: Regeneron is plaintiff and bears the burden of going first - and showing its cards - more frequently than the defendants. That comes with the territory as plaintiff. The Court assumes good faith and that each party being told now to stick with its stated positions will be neither surprised nor prejudiced by so doing. Here, the issue is easily resolved by removing the requirement of any meet and confer and requiring the parties to rest with the intrinsic and extrinsic evidence previously proffered to the other.
