MEMORANDUM Opinion and Order signed by the Honorable Edmond E. Chang. For the reasons stated in the Opinion, the Defendants' motion to dismiss 22 is granted in part and denied in part. The Fourth Amendment claim survives and the substantive due process claims are dismissed. The state-law claims remain in the case; a federal claim has survived, so the Court of course will not relinquish supplemental jurisdiction. At the 08/02/2016 status hearing, the Court will set an answer deadline and the discovery schedule. The Court does encourage the parties to engage in settlement negotiations, now that the dismissal motion has been decided and the scope of the remaining claim is known.
