St. Eve:as to E5BA6F9: As indicated in its indictment, the government charges E5BA6F9 with violating 18 U.S.C. § 922(x)(1)(A)(B), and 18 U.S.C. § 924(a)(6)(B)(ii). Section 924(a)(6)(B)(ii) requires the government to prove that E5BA6F9 violated § 922(x), and (1) knew or had reasonable cause to know that (2) the juvenile intended to carry or otherwise possess or discharge or otherwise use the handgun or ammunition in the commission of a crime of violence. In its indictment and proposed jury instructions, the government indicates that the "crimes of violence" it intends to prove are first degree murder, aggravated battery with a firearm, and aggravated discharge of a firearm. The government should be prepared to explain (with citations to authority) at the final pretrial conference why those three crimes constitute crimes of violence under the relevant statute, 18 U.S.C. § 16. The government should keep in mind that the Seventh Circuit held that the definition of "crime of violence" in the residual clause of 18 U.S.C. § 16(b) is unconstitutionally vague. St. Eve:as to E5BA6F9: Defendant E5BA6F9, in her Motion to Suppress Identification Evidence and Testimony, "requests an evidentiary hearing about the circumstances of the identifications, so that he [sic] can demonstrate to the Court the unnecessary suggestively [sic] of the procedures and the unreliability of the resulting identifications." (R. 45 at 8.) Defendant further explains, however, that "Ms. E5BA6F9 has requested a hearing, but not to present witness testimony. Instead, the hearing is to present the video and identify the witnesses therein so that the Defendant can establish, considering their initial statements, the statements made after viewing the video and the vantage point of the witnesses and/or the location of the alleged transfer, that the evidence supports a finding that the witnesses never actually observed the alleged transfer and that the Government will be unable to establish the reliability of the proposed testimony. Here, there is no need for a credibility determination because it is all reflected on the video." (R. 78 at 4.) The government has provided Defendant with a copy of the video. In addition, the Court has a copy of the video. Thus, in light of Defendant's stated purpose for the hearing and her admission that no credibility determinations are required and no witness testimony is necessary, no evidentiary hearing is needed. If the Court needs additional argument from the parties based on the video, the Court will inform the parties in advance. As a result, the suppression hearing set for 6/27/16 is stricken. Instead, the Final Pretrial Conference and Jury Instruction Conference will be held at 9:00 a.m. on 6/27/16. All counsel trying the case MUST be present at the final pretrial conference. Although Defendant claims she needs additional time to protect "Lee's" rights as secured by the United States Constitution," the Court assumes she means Defendant E5BA6F9 rights. The Court grants the motion 73 in part. Defendant's time to reply to her motion to suppress (R. 44) is extended to June 6, 2016. Defendant's objections to the government's jury instructions and counter instructions must be filed by June 6, 2016. Responses to the government's motions in line are due on or before June 13, 2016. As for additional motions, the Court will address them if and when they are filed. The Court is not persuaded that Defendant's pretrial confinement has compromised her ability to assist in her defense. At Defendant's request, the Court immediately requested that the US Marshals transfer Defendant to the Metropolitan Correctional Center to enable her to have more contact with her attorney. Numerous months have passed and counsel has not raised this issue despite several status hearings in court. Moreover, when the Court offered to have a CJA attorney appointed to assist with the defense, both Defendant and her current counsel declined the request and said another lawyer was not needed on the case.
