ORDER granting 3 Motion to Dismiss. Announced to the Court that they have settled Ogmas claims for relief against Sony Ericsson asserted in this case. Ogma and Sony Ericsson have therefore requested that the Court dismiss Ogmas claims for relief against Sony Ericsson with prejudice and with all attorneys fees, costs and expenses taxed against the party incurring same. The Court, having considered this request, is of the opinion that their request for dismissal should be granted. IT IS THEREFORE ORDERED that Ogmas claims for relief against Sony Ericsson are dismissed with prejudice. ORDER - Accordingly, the Clerk is hereby directed to assign the severed action a separate civil action number and to file therein copies of Plaintiffs Complaint and this order. Such action shall remain stayed until the resolution of all International Trade Commission proceedings between Plaintiff and Sony Ericsson, including appeals. Upon the conclusion of those proceedings, either party may move for an order lifting the stay. (Case is Severed from case number 2:11-cv-166).
