P. 11(b), since the complaint alleged that there was likely to be evidence of patent infringement after reasonable opportunity for discovery, without any indication that plaintiff had conducted a reasonable inquiry, as required by Rule 11(b). Based on the memorandum submitted by plaintiff on 10/31/03 that outlines plaintiff's pre-suit inquiry, the court has determined that plaintiff has complied with Rule 11.
